The Trump Card...

Trump Just Doesn't Get It

Former Trump WH lawyer Ty Cobb on Trump promising to release a “large complex, detailed, but irrefutable report on the presidential election fraud”:

“There’s a good chance that whatever document he produces ends up as evidence against him. It could even end up as the basis for an obstruction count against the author because it’s likely to be fiction and solely for the purpose of contaminating the jury pool.”

Arizona Next?

"The [AZ] attorney general’s office has confirmed that an investigation into Trump, his allies and Arizona’s fake electors is underway, but gave no indication on when charges would be announced."

"Arizona is mentioned several times in Georgia’s indictment as Trump and his allies reportedly contacted lawmakers to get them to overturn election results in his favor."

At this point the Democrat party is overplaying its hand. These state-by-state indictments now more than ever appear to be a coordinated effort to prevent Trump from running a campaign. Many of these charges could've been brought years ago, but instead are now timed to interfere with a presidential election.

Let's keep in mind that indictments are easy, and to date Trump hasn't been convicted of a single crime. But considering the number of charges and the venues assigned, he's probably going to be convicted of something - especially in DC. So then he's likely got a felony conviction and the ensuing appeals that will take years. Will that give the Democrats their desired result of taking Trump out of the race? If so, what will future elections look like with that template in place?

"Ms. Willis had every expectation she would get her wish list met because that’s how grand juries operate every day across America. They hear one side of the story, presented in the light most preferable to the government and damaging to the accused. It’s a wonder any defendant can escape indictment..."

Or just separate efforts to hold him accountable ... ;)

Or timed to avoid running into the Statute of Limitations.

While it wasn't him personally, we need to remember that Donald Trump is the head of this organization:

Trump Organization found guilty on all counts of criminal tax fraud

It appears to be a coordinated effort because Trump's effort to overturn the 2020 election was itself a coordinated effort. The investigations followed the evidence and the indictments reveal the story, not of a politically motivated and coordinated effort to prosecute Trump invented out of thin air, but of Trump's prior coordinated attempt to illegally retain the power of the presidency. He lost the election. His coordinated efforts to thwart the Constitution and stay in power created the trail of evidence now unearthed. The evidence of Trump's et al criminal activity provided the road map the prosecutors followed, and the story now told in the indictments.
Many of these charges could've been brought years ago, but instead are now timed to interfere with a presidential election.
Yes, they could have been brought years ago, but at every turn, Trump and his cronies did everything they could to delay everything they could. They did not say I am innocent and I want the truth to come out, so I'll cooperate in every way to quickly bring out the truth. They instead claimed (improperly) that the process is illegitimate and there is no way they want the truth to come out. Knowing they are guilty of serious crimes, they did and continue to do everything they can to delay, delay, delay.
Let's keep in mind that indictments are easy, and to date Trump hasn't been convicted of a single crime.
Yes, the threshold for indictments is "probable cause," and the threshold for conviction is "beyond a reasonable doubt." So until these cases are heard in jury trials, we won't know if the threshold of "guilty" has been met. But where Trump's cases have been heard by juries before (Trump Organization tax fraud, E. Gene Carroll), the juries have not been kind to Trump.

Also, the numerous legal arguments Trump has made in court in recent months and years have not done well. His current score is 3 wins in court and 96 losses (details here). That does not bode well for Trump as he now faces 91 criminal felony counts in four indictments. The DOJ conviction rate is very high (95+ percentile). They don't bring cases to court they don't think they can win. The Georgia indictment lists several smoking guns. Jack Smith and Fani Willis are deeply experienced and highly skilled. Trump is in deep, deep trouble and he is likely going to prison.

But considering the number of charges and the venues assigned, he's probably going to be convicted of something - especially in DC. So then he's likely got a felony conviction and the ensuing appeals that will take years. Will that give the Democrats their desired result of taking Trump out of the race? Future elections will look normal and trusted as the rule of law will have been upheld, the Constitution will remain intact, and no one will be stupid enough every try again what Trump tried and failed to do.

Trump's antics are putting US democracy through a stress test now, and democracy is holding up. The recent midterm elections were held without major controversy. Despite Trump's efforts to undermine them, the judicial branch and executive branch law enforcement remain intact and functional. Trump's calls for protest in the streets have been ignored by his supporters. Trump has been unable to stop ordinary people on grand juries from issuing indictments. Fearing the consequences of missing a court proceeding, Trump dutifully appears every time he is ordered to do so. The justice system is intact and Trump is increasingly being held accountable.

When this is over, the stress test will produce an elections system that is cleaner and more secure than ever. We're already seeing the positive changes. Vote by mail is an excellent system. Trump and other Republican once opposed it. Now they support it. The security of voting machines was questioned. You can be sure that election officials have already doubled down on that to ensure they are even more secure in the future. Drop box locations and security have also been questioned. While no widespread fraud has been found anywhere, drop box security has also been improved.

The people and institutions who told or amplified bogus lies about the 2020 election are losing their law licenses, being charged with crimes, and/or paying massive fines. In fact, the 2020 election was the most secure in American history. Going forward, elections will be even more orderly and secure.

Another Brilliant Trump Marketing Move (if Made)

Readers here know I don't like Trump much, but when he makes a brilliant move, I give him credit. If he does what is discussed below, it will be a brilliant move. It's not the move of a party team player. It's not a move that will be appreciated by his primary rivals, but in terms of stealing the spotlight from them and putting it on himself, it is brilliant.

"According to Greg Bluestein, local political operatives in Georgia are buzzing with speculation that Trump might surrender to authorities during the Republican primary debate next Wednesday to steal the other candidates' thunder." (Source: Twitter)

That’s impossible. There is no thunder left to steal from the other candidates.

Last night on Truth, Travis Tritt posted that he has "sources" that told him Brian Kemp of Georgia was over 7 million dollars in debt before the election and now he has no debt and that Dominion paid him off, wonder if this is the info that Trump is going to release on Monday.

The innocent explanation is a clerical error which was quickly rectified. The nefarious explanation is an intentional leak. Which is true? We don't have enough info to say for sure at present.

Either way, I don't see this error/leak as consequential. It's not going to stop the grand jury from indicting. It's not going to undermine any indictment that comes out. The public impact will be minimal as the indictment itself will capture the news cycle for days.

The DA can easily explain away the posted document as a draft that was posted in error. And the error was immediately rectified when discovered. Beyond that, what reasonable remedy is there? I know that won't pass the smell test with MAGA, but that's the likely way it will work out.

This is an unfortunate development and embarrassing to the Clerk of Court and Fani fans I'm sure. I cringed when I saw the story. It would have been better for all concerned if this had not happened.
Now we know. It was as I thought; a clerical error.

The Trumpers will still say there is some sort of conspiracy, in the end, it was human error, nobody is perfect, not even Trump.

Judge Orders Giuliani to Produce Evidence or Face Fine

Guiliani said financial hardship is his excuse for not providing evidence he was previously ordered to provide. The judge is not having it. “I know what hardship looks like. You haven’t even come remotely close,” he said.

If they made “mistakes” on that, what other sloppy errors did they screw up on?
They even mistakenly released the names of the grand jurors. Sloppy sloppy.

In Georgia, the law provides that grand juror names are disclosed to the public. No mistake. Not sloppy.
