You don't get search warrants without demonstrating probable cause to a judge. The fact that they obtained eight search warrants means a lot of probable cause existed. Exactly where did it exist and who or what did it concern? We'll have to wait for the affidavits to be unsealed to find out.
Which judge was it again that ok’d the search warrants? That’s right the Clinton judge that the DOJ shopped for who didn’t recuse himself.

More Charges for Trump Plus a New Defendant

The Miami grand jury is still investigating. Here's the latest:

"Under the superseding indictment, prosecutors have charged Trump, Nauta and De Oliveira with two new obstruction counts based on allegations that they attempted to delete surveillance video footage at Mar-a-Lago in the summer of 2022.

"The third defendant added to the Mar-a-Lago classified documents case, Carlos De Oliveira, faces the following charges:

  • Conspiracy to obstruct justice
  • Altering, destroying, mutilating, or concealing an object
  • Corruptly altering, destroying, mutilating, or concealing a document, record, or other object
  • False statements and representations"

Except for the Mar-a-Lago warrant that was unsealed after Trump announced it and DOJ agreed to let it be unsealed, we do not yet know which judge issues which search warrants. Nor do we know on whom they were served or in which states or facilities or devices.

If Elections are About the Economy ...
Awesome. That second job can help pay for gas (that’s up to an 8 month high) to get to work and pay for the much higher cost of groceries and just about everything else affected by inflation. Bank accounts dwindling…

New Charges for Trump

I listed the charges against new defendant, Mar-a-Lago Property Manager Carlos De Oliveira above.

"Trump now faces two new [felony] obstruction-of-justice charges related to the alleged attempt to erase the security camera video. In addition, the new indictment adds a felony count under the Espionage Act stemming from his alleged possession of the war plan." (Source)

Trump's S_ _t is Weak and Getting Weaker

The superseding indictment now lists the following charges against Trump. Most of these were previously made in the original indictment:

Willful Retention of National Defense Information (32 counts)
Conspiracy to Obstruct Justice
Withholding a Document or Record
Corruptly Concealing a Document or Record
Concealing a Document in a Federal Investigation
Scheme to Conceal
False Statements or Representations
Altering, Destroying, Mutilating, or Concealing an Object
Corruptly Altering, Destroying, Mutilating, or Concealing an Document, Record or Other Object

The new charges concern the highly classified document Trump had and shared with uncleared people at Bedminster, NJ. And they concern Trump's attempts to delete the Mar-a-Lago security tapes that show certain records being moved to hinder government efforts to recover them.

According to the indictment, prosecutors have witnesses and a tape recording in Trump's own voice that proves Trump had and shared a highly classified document. And they have at least one witness (Employee # 4) and documentary evidence (texts between Trump employees that confirm Trump's involvement) that show Trump's direct involvement in efforts to delete security tapes to cover up crimes the tapes show being committed.

All of these acts were committed long after Trump was no longer president so there is no presidential immunity, executive privilege, attorney client privilege or other such protections Trump has previously (but unsuccessfully) claimed. The clear purpose of these acts was obstruction of justice, the penalty for which can be up to 20 years imprisonment. The Bedminister crimes have a penalty of up to 10 years.

Key Question 1: If it was OK for Trump to have the documents in question at Mar-a-Lago, why did he feel the need to hide them when a subpoena ordered him to return them, and why did he seek to delete the security tapes that showed the documents being moved around the property?

Key Question 2: How stupid do you have to be to, illegally posses a top secret document, transport it to New Jersey, there discuss it and show it to four people (witnesses) who were not cleared to see it, and to do this when you were being audio recorded you with your knowledge and consent, and to say while being recorded that the document is classified and you should not be sharing it? (Trump has claimed there is no actual document. In the indictment, DOJ says they have the document.)

With multiple cases developing against Trump, and each including dozens of counts, it's worth noting that prosecutors need only win on one count to gain a conviction that sends Trump to prison. Think about just one of the counts that was filed today; the one about the security tapes. The indictment includes a day-by-day narrative that explains in clear and easy terms who did what and when. It's an easy story for a jury to understand, and it is backed by strong evidence.

A team of Trump lawyers will vigorously fight that count. A ton of time and resources will be poured into that. That charge alone would be a major felony case if it stood alone. But it is just one of dozens of counts that must be similarly fought.

In this battle, Trump is heavily charged, out-manned and outgunned, and he has no solid legal ground to stand on. In the federal cases, he faces highly skilled DOJ prosecutors whose win rate is very high. Per Google Bard, "According to the Pew Research Center, the U.S. Attorney's Office secured convictions in at least 99.96% of all cases in 2018."

Trump has rights as all criminal defendants do, but he must also live with his deeds. The law and the facts are not on his side.

Given the strength of the evidence that has been developed to date, it seems to me that prosecutors will win on dozens of counts, if not all of them.

Trump's lawyers do not seem to be listening to Levin. What's up with that? Are they not watching FOX News? Are they glued to Twitter instead, waiting for Tucker's instructions?

It’s coming. Stay tuned.
I've been staying tuned. It is increasingly satisfying as the cases proceed and developments unfold.

While Levin enrolls his viewers in fantasy notions, Smith issues a superseding indictment, prepares a new indictment and charges an additional defendant. And that's just this week.

In previous weeks, we have seen the following questions answered. The list is updated to include this week's developments. If you look close, you'll see Levin did not answer even one of these questions in a way that made a difference for Trump and his co-defendants.

No, a special master will not be used.
No, the documents trial will not be postponed until after the election.
No, Trump is not immune from defamation charges because he was president.
No, the falsified records case will not be moved to federal court.
No, the falsified records case will not be dismissed.
No, the falsified records case judge will not recuse.
Yes, the Trump Organization is guilty of tax fraud.
No, executive privilege cannot be used to keep Trump aids from testifying.
No, Fani Willis will not be disqualified from working on the GA election interference case.
No, the GA Special Grand Jury report will not be thrown out.
Yes, a former president of the United States who is again a candidate for president can be indicted, arrested and arraigned.
Yes, the $5 million in damages the jury said Trump must pay Carroll is reasonable.
Yes, the other Carroll case can be amended to include Trump's recent statements and more damages can be sought.
No, the NY AG lawsuit will not be dismissed.
Yes, certain Trump attorney's can be compelled to testify because attorney client privilege does not apply (furtherance of a crime).
Yes, Trump is a rapist.
Yes, Cohen and Trump will settle Cohen's unpaid legal fees lawsuit "in a manner satisfactory to all parties," and this case will not go to trial.
Yes, the Miami grand jury will continue its investigation and produce additional indictments, even after it first indicted Trump.

And no Rudy hasn’t “flipped”. It’s Fake News.
Bannon and Rudy are laughing about it right now.
Rudy may not have flipped, but I bet they got the info they needed from him. Like Trump, the arrogance runs deep, every time they open their mouth, they give the prosecution more evidence.

You have the right to remain silent, anything you say can and will be used against you in a court of law.

Its amazing they dont understand this basic sentence.

It is Trump who ruined the lives of these two people by asking/enticing them to commit illegal acts for his benefit.

He has been spewing out crap like this for years. But as the all-too-slow wheels of justice turn, Trump is finding out that these garbage posts have no effect in domains where the facts and the law matter. Trump is a criminal defendant now but he keeps trying to score points int the public domain. That's fine in the public domain but ineffective in court.

We won't know for sure if Rudy has flipped or not until the indictment comes out regarding Trump's efforts to overturn the 2020 election. And we may have to wait longer if Rudy is not named in it or the witness list is later revealed. But at some point, the witness list will become publicly known. That's when we'll know that Rudy has flipped.

I am convinced he has flipped because of the lengthy proffer meeting he completed with DOJ. People who don't flip don't have proffer meetings, people who flip do. Rudy is a documented liar. That's why he's losing his law license. Anything he says to the MAGA base about what he has or has not done should be taken with a huge grain of salt.
