It's Over For Now

It seems to me that every new development in the Manhattan case in which Trump is the criminal defendant has happened, and it will be quite some time before anything new surfaces.

  • The grand jury issued an indictment
  • Trump was arrested and arraigned
  • The Manhattan DA had his press conference
  • Trump made his speech
  • The talking heads have said pretty much everything they are going to say about this again and again and again for the next several months.

While attorneys will be active with various motions and hearings, Trump himself is next due in court in this case in December. I can get many good things done between now and December. Putting a lot of time into forming opinions about the various aspects of this case is not one of them. I don't have the information the lawyers have and most public opinions uttered about this will count for nothing.

Believing Trump committed crimes and wanting to see him brought to justice, I'm pleased to see Trump become a defendant in a criminal case, and I'm quite content to wait until December to see what develops then. With three other grand juries now investigating Trump, I think the Manhattan case will the least of his worries come December.

Donald Trump has been arrested. The world did not come to an end. His supporters did not take to the streets. Tomorrow will look and feel pretty much the same as today.

Oh. By the way, an important election happened in Wisconsin today in which the Democratic candidate for state supreme court justice soundly defeated the Republican; giving liberals the majority on the court for the first time in 15 years.

I think it was the pro-abortion vote that gave her the win. While Trump is getting all the media attention and rallying Republicans around him, the issue that is driving motivated voters to vote is abortion rights. The Supreme Court revoked Roe v. Wade but the voters aren't having it. And while Trump complains about this and that, these voters are taking to the streets and the polls to elect pro-abortion people when the opportunities arise.

How many times do you think we'll hear that between now and December? A hundred? A million? A hundred million? And how much difference do you think saying it over and over and over again will make?

Enjoying the presumption of innocence he does in court, and having his due process rights intact, and being supported by the expert legal team he is, Trump will have the opportunity to make that very argument in court when the appropriate time comes. The motion to dismiss will be carefully crafted and fully supported by the best legal arguments a skilled legal team can make.

Then the judge will consider the points made by both sides. And then, you and Trump will learn whether or not "they have no case."

That's the way it works for criminal defendants. And Trump[ is now a criminal defendant. Criminal defendants don't get to decide the merits of the case being made against them. The judge does.

Oh yes and the Democrat judge gets to decide along with a Democrat leaning jury....no bi-partisan court there at all. The courts are no longer blind.

That's your view. I view the court as more objective. Either way, the decision about "they have no case" will be made by the judge. Trump gets to choose the public narrative he wishes to promote. The judge will be the one to decide the merits of the case.

Why Has Trump Stopped Calling for Protests?

A couple weeks ago, Trump called for "PROTEST PROTEST PROTEST." In his remarks last night, he did not call for protest.

1. Is that because protesters have not shown up in large numbers and Trump does not want to be further embarrassed by empty calls?

2. Is it because he is mindful of what the judge told him in court yesterday ("refrain from making comments or engaging in conduct that has the potential to incite violence, create civil unrest or jeopardize the safety or well-being of any individuals.")?

3. Or is it because Trump is a master strategist with a secret plan to unleash and focus the rage of his supporters at a later date?

Personally, I think it's because of reason 1. Trump did nothing to support those who turned out to support him on Jan 6. Very few are wiling to take to the streets for him now.

A Remarkably Tolerant Judge

Judge "Merchan said the court would not issue a 'gag order' against Trump, citing his First Amendment rights as a candidate for president, but urged 'counsel on both sides' to speak to their clients and witnesses to tone down the rhetoric.

"'Please refrain from making comments or engaging in conduct that has the potential to incite violence, create civil unrest, or jeopardize the safety or well-being of any individuals,' he said. 'Also, please do not engage in words or conduct which jeopardizes the rule of law, particularly as it applies to these proceedings in this courtroom.'

Merchan added that this was a request and not an order.

"'But now that I have made the request, if I were to be handed something like this again in the future, I have to take a closer look at it,' Merchan said." (Source)

4. The Trump supporter's concern that if they are merely protesting and get attacked by Antifa and fight back, the dumb prosecutor will let Antifa go and put the Trump supporters in jail without bail for defending themselves.

A concern held by some, I'm sure. I've also seen some Trump supporters warn others against a trap. Whatever the reason, bummer for Trump if he can no longer martial people into enraged crowds at locations other than rallies. He was doing his best to whip things up pretty good before he went to his arraignment.

Pence Will Not Appeal

"WASHINGTON (AP) — A spokesman for Mike Pence said Wednesday that the former vice president will not appeal a judge’s order compelling him to testify in the Justice Department’s investigation into efforts by Donald Trump and his allies to overturn the results of the 2020 election."

Trump may appeal. If he does, he'll lose, just like he lost all other executive privilege claims before.

No bummer. He keeps surging in the polls, as Biden flounders. He's getting stronger, not weaker. Some's previous analysis about his demise appears to be greatly exaggerated.
