Now i got a question. If chief justice Roberts is not presiding over the impeachment trial is it even legal ? Because a Democrat senator is in his seat.....acting like a supreme court judge.

The Chief Justice presides over trials of presidents, not private citizens. So in this case, they just pick a juror to also be the judge.

Here we have Senate Trial Judge Patrick Leahy with House Impeachment Manager Eric Swawell.

Nope, he actually isn't.

The reason a Democratic senator is there is because the Democrats control the Senate, and in the absence of the vice president (who is also president of the Senate), a person is designated the as president pro tem of the Senate, who takes the place of the vice president, when they are absent, performing the function of presiding officer ...

Also the individual being tried is no longer in office, and no longer President ... being a sad, pathetic loser and all.

It's legal because of the specific circumstances of this particular trial (ex-officeholder being tried, etc.)

All this may seem very strange and odd to those who are unfamiliar with how our government is structured and works ... but we are happy to provide the above synopsis to enlighten those who are unfamiliar.

The cool kids shorten it, but it's it's president pro tempore, (Latin, "president for a time"). The Constitution requires the Senate to elect a president pro tempore, and by custom it is the member of the majority party with the longest record of continuous service.

The Founders also knew there were legal avenues to take if need be of a President who may have committed a crime and then left office.

Just so we're clear on this:

You would be fine with Uncle Chuckie putting together a criminal referral ... and getting the Senate to vote to authorize sending it to DOJ then ?

You say he incited a riot. There are multiple reports that a lot of it was preplanned about a couple months. So his speech didnt incite the riot. Also there is a report that Trump requested that 10,000 National Troops be ready. Both Sgt. Of arms in House and Senate didn't take action on the request. What did Nancy and Mitch know and when did they know it? This impeachment thing could very well be mostly a coverazz excercise for gross incompetence.
It makes no sense that Trump would try to incite a riot when he also wanted National Troops to be present. # Factsmatter1

Unlike some I'm not in favor of criminal referrals without evidence.
