The battle at Lexington & Concord happened because the British, (which was the lawful governing body to the colonies) decided to disarm the population. Acting on a tip they were informed that the farmers had a large store of powder and shot stored in their town hall.

The farmers responding to Paul Revere and a few other riders, cleared the arms out of the town hall and gathered on the village green to defend their rights as British Citizens to own firearms.

Had you guys been around in the 1700's the US would still be a British Colony.

That was way out on line OntarioVanMan, Terry is not a spy he is just doing the job he was hired to do. The man was in the Navy and did drive truck at one time before driving a van with Robert Express. The man know his stuff and has been in the business a long time.

Darn Bruno..couldn't leave it on page one eh? I said i was done..wanna make an issue of it?

As I said in link# 15...it is my opinion of the position, nothing more, nothing less...

I think the position is no more then a feel good, look what we do for you proposition..created at a time when the economy didn't need such a thing....at a time the rate was cut for cargo vans...an expense not justified by the times.

I respect Terry the man greatly...not the position.

Your response doesn't surprise me at all.

When you agree to drive a commercial vehicle, you know the rules....when you take the job you are accepting and voluntarily giving up that right while doing such job...It is ones own choice when doing this job...if you don't want to forfeit such a right, don't do a profession that requires it...you/we do have a choice.

Okay, we forgive you for that.

Don't you just love it when FedEx Custom Critical makes the news? Way to go, driver. You're a credit to us all (NOT).

And now we know the rest of the story. Two unfortunate incidents at about the same time. It certainly didn't help. Also, this came just a week after an AWOL soldier and his girlfriend tried to enter MacDill/CentComm with a load of weapons and ammo.

Man who tried to enter MacDill Air Force Base with guns was AWOL - Miami-Dade Breaking News - MiamiHerald.com

That might make the security folks a bit uneasy.

You dear sir are a rather offensive little person. You make blanket statements aimed at a group of people who are my family, a number of whom I know for a fact served this country in the military.:mad::mad:

We live in the reality of the current world, and good, bad or whatever, it is what it is and the person that doesnt take current laws and regs into account is a FOOL, and not long for this line of business. That FECC driver was an idiot, hands down. No sympathy for him here. Yeah he has the right to keep and bear arms, where and when it is legal to do so. I happen to fully support the 2nd amendment, however a truck really is the last place to keep a weapon. It would be open season on 4 wheelers for one!
Idealism is great for getting people killed, not so good for paying the bills and keeping a business going.

Well said Phil. Not only is this driver a credit to us all, he/she is probably responsible for your cabs and sleepers being turned upside down the next time you show up at this site. I'm sure they will be thinking if one (FECC) showed up with a gun, surely the rest may try to do the same and not declare it when asked.

So my friends, prepare to bend over and be probed! LOL

LONG STORY SHORT DRIVER SHOULD OF CALLED THE BASE OPERATIONS MANAGER OR THE MP'S ON SITE AND TOLD THEM WHEN HE WAS GOING TO BE THERE. IF HE DID THIS HE WOULD STILL BE CONTRACTED TO THE FED.

Yep, that's all it would have taken...a wink and a nod and FedEx would never have known any different.......REALLY???

Those of us on this forum are "uninformed" about rights and liberties......REALLY???

What part of this conversation concerning the rules of carriers don't you understand? When this driver signed on, whether as an owner/operator or a driver for someone else, he AGREED to the conditions/rules of that carrier........

LONG STORY SHORT.........

I didn't miss the part of your post that acknowledged that the driver had broken a FedEx rule but you seem to have thrown that aside with this comment......

LONG STORY SHORT DRIVER SHOULD OF CALLED THE BASE OPERATIONS MANAGER OR THE MP'S ON SITE AND TOLD THEM WHEN HE WAS GOING TO BE THERE. IF HE DID THIS HE WOULD STILL BE CONTRACTED TO THE FED.
and that's the one I quoted in my other post.

Just because we have the right to do something doesn't mean that we should. Common sense has to kick in at some point.

As I said before, just because we have the right to do something doesn't mean that we should do it everywhere. In this day and age with road rage being what it is, I shudder to think about many of the idiots we see daily as gun carrying drivers. There are other ways to protect ones self out there on the road.

I wasn't throwing it aside i was just finishing with what he should of done. Had he done this the fed would of never known.

And of course that would have made it right! I'm finished with this now, no need to respond, I get where you're coming from.

back before the US was populated by mostly hermaphoditic metro cry babies - citizens carrying weapons was the norm.

Imagine sitting on the subway next to a younge black boy ( 14 ), in New York carrying an M-1 Garand across his lap, in Brooklyn no less and thinking nothing of it.

When could this have occurred? Ancient history?

NO, the boy was Colin Powell, up and untill the late 60s every High School in New York city had a marksman team. They carried their guns to and from school, practically every day. Oh how barbaric.

Incidently, Judge Anthony Scalia also was a member of the New York school district rifle squad.

LOL,

guns r scarry. I'm so afraid. Only horrible Bad mean and stupid people carry guns.

The government will protect us. Just like Hitler did, he made all the bad people turn in their guns. Nasty jews and christians, then he gassed all 16 million of them. Germany lived happily ever after.
(oh yeah he also killed people who were dumd or gay or metro)

Lol

Just an FYI, the guy may be in trouble not for the base issue but because NJ may not have a reciprocating agreement with his home state. NJ does not recognize any other state's CCW permits - PERIOD. He wasn't on Federal property from what I have been told.

Regardless if it is his 'right', we work within a constitutionally regulated industry, not a legislated industry. He doesn't have rights per se when it comes to some issues.

Number one, sign on with FedEx, follow their rules.

Number two, there is no NEED for a CCW OR reciprical rights. The Second Amendment assures us the ability, without government restriction, to carry or not carry as we please, where we please and when we please. That is what is known as a "RIGHT"!! Remember rights? We used to have them in this country at one time.

By the way, the Second Amendment has NOTHING to do with hunting. It is about defense only. Defense of Self, Family, Home and Property from ANYONE who would threaten, INCLUDING governments.

under the commerce clause. The fed gov is granted the authority to regullate interstate commerce.

so it is constitutioonal for the feds to place restrictions on commercial vehicles and there operators. When they operate in more than one state.

Dooes that authority over ride the bill of rights

Could the dot make a rule banning
truckside advirtisement

Could the dot ban jews from getting commercial licenses

No. However, driving a commercial motor vehicle is a privilege, not a right, and in order to drive a commercial motor vehicle, you must abide by certain rules and regulations. If you don't wish to abide by them, then you won't be able to drive a commercial motor vehicle.

Could the dot make a rule banning
truckside advirtisement
Yes, but unless they could justify it for safety reasons, it would be overruled in court for being a violation of Free Speech.

Could the dot ban jews from getting commercial licenses
Yes. The Civil Rights Act prohibits the DOT from banning Jews from getting a CDL on the basis of them being Jewish, but regardless of your race, color or creed, if you have done something that would prevent you from obtaining a CDL, you won't get it, even if you are Jewish.

could the dot require drivers to testify against themselves in court
No. The 5th Amendment to the US Constitution provides that an individual cannot be forced in any criminal case to be a witness against himself. You have the right to remain silent when questioned by law enforcement, including police, lawyers and judges. This right to remain silent may be exercised at any time when your answer to any question in any circumstance may potentially incriminate you in a criminal proceeding. This includes casual conversation prior to being arrested.

Could the dot enforce a death penallty for log vioilations
If there was a law allowing for the death penalty on the books for log violations, yes. Currently, I think only Ohio has that one, so I'm not sure if the DOT or just the Ohio State Police could enforce it.

could the dot jail a driver wwithout
a trial
Sure. All it takes is probable cause to arrest someone. In most states the police have 48-72 hours from the time of arrest to them finding a judge and filing the charges. Some states (MO) it's as little as 20 hours before formal charges must be filed. With federal charges it's 72 hours. Within that time limit you must have an arraignment or "first appearance" before a judge where the charges are read and you enter a plea. The judge can dismiss the charges outright, or set a date for trial. If a trial date is set, he can release you on your own recognizance, set bail which you can pay and get out of jail, or depending on the severity of the charges, hold you in jail without bail until trial.

feel free to give answer if you dare
One cannot ensure that the rights and liberties guaranteed by the Constitution remain firm and steadfast if they begin to take on an aura of illusory idealism. Most Americans do not truly know or understand their rights. These rights are real, they are substantive, and they apply to our everyday life. Knowing and exercising these rights is what maintains the balance of power in our system of government. Or what's left of it.
