OJ Simpson’s lawyer Johnny Cochran criticized publicly the judge and prosecution daily. It’s the first Amendment.

The question I asked was, " If it is a strategy, how does this help Trump? What benefits come from calling your judge 'an out of control nut job?'"

In other words, you are choosing to not answer the question I asked.
In other words, no strategy needed. The judge has already made up his mind.( Based on his actions and comments) So at this point, it’s a matter of Trump just exercising his 1st Amendment right and expressing his opinion.

Thank you.

I'm not sure if Trump slamming the judge is a strategy or not. If it is not, his distasteful and disrespectful comments are the unhinged rants of a man consumed by rage, or who is otherwise conditioned to endlessly spew such vile.

There may be a strategy to it. Trump knows he is doomed in this case. His fraud has been exposed and the only thing left to learn is how much his fraud will cost him; that is, what the penalties are and how much the disgorgement will be.

One penalty has already been established. Per Judge Engoron's order, the business certificates of Trump's New York businesses will be canceled, and the businesses will be transferred to a court-appointed receiver who will dissolve the businesses. Some have described this as a corporate death penalty, and that description is apt. Trump's New York businesses will pretty much be put to death.

Trump quickly appealed that order and the appeals court granted a stay. The order was not reversed or overturned. The stay means the order will not be executed until the appeals court has taken whatever time it needs to rule on the appeal. The appeals court may reverse or modify the order at a later date. All parties are now waiting for that ruling.

The strategy, if you can call it that, may be Trump is endlessly peppering the judge with insults in hops of triggering an emotional response from the judge that Trump can than use to say it's not about the law, but about how this "Trump-hating" judge feels about Trump. That's not much of a strategy, but because his case is so weak, Trump is left with little else.

So what? It’s his 1st Amendment right to defend himself publicly. He was referring to Cohen, but even if he was referring to the clerk, he should be allowed to comment about what she is doing when she is interjecting herself in the proceedings with the judge. Trump should be allowed to criticize the process, and if the judge and clerk are involved in the process, they aren’t immune from criticism.

Trump is not a free man. He is a defendant subject to the rulings of the Court. His 1st Amendment right goes only as far as the judge says it goes, and in this case the judge has imposed restrictions. What you say is true and should be, is exactly what the judge said is false and should not be. And because he is the judge, his opinion prevails, not yours.

Appealable issues too.

Yeah, yeah, yeah. Appeal, appeal, appeal. If you review Trump's history in the courts, you will see that he almost never wins when he appeals. His loss rate on appeals is worse than his loss rate overall. At present, his overall loss rate is 92.2%. In this case, the sooner

Trump appeals, the sooner his New York businesses will be dissolved. Oops, check that. Trump has already appealed that ruling. The clock is ticking.

Certainly not in the DC and NY courts. This will need to go to the Supreme Court at some point. Lawfare has their template. Weaponize the legal system and file frivolous charges and lawsuits in deep blue areas with partisan judges and juries as the arbiters. The appearance to the uninformed is that this all fair and legit. But eventually the cases will get to the Supreme Court where these egregious decisions will be overturned.

Trump's appeals have reached the US Supreme court a few times in the last few years. I do not recall the number. Neither do I recall a single case where that Court, including three Trump-appointed justices, ruled in Trump's favor. His loss rate at the US Supreme Court is 100%, compared to his overall loss rate of 92.2%.

The reason his loss rate is so very high is (1) he is guilty, or (2) he brings garbage cases to court.

EDIT: Not knowing the detailed history of Trump's appeals and emergency applications to the US Supreme Court, I asked Google Bard. Bard does not always give correct answers, and I do not have time to check each case before sharing the results here. But without such checks, Bard says there have been 11 such cases since 2016. Trump lost 10 of them. Again, I have not confirmed what Bard says but that's the gist.

Good. When the Supreme Court rules in his favor the Left can’t whine that it’s just because they’re a “conservative court”.

Judge Chutkan Reinstates Trump Gag Order

"The judge overseeing Donald Trump’s federal election subversion criminal case has reinstated the gag order she issued on the former president earlier this month.

"US District Judge Tanya Chutkan also denied Trump’s request to issue a long-term stay of the order – which bars the former president from publicly targeting court personnel, potential witnesses or the special counsel’s team – while his appeal of it played out."

We'll just have to wait and see (1) if he appeals to the Supreme Court, (2) if he does, will the Court take up the case, and (3) if they do take up the case, how will they rule?

Trump is very, very good at losing in court. I'm confident he will lose this case too after all appeals are heard.

BTW, this Sunday evening, Trump just added a new loss to his tally. Like I said, he is very, very good at losing in court.

As long as he doesn’t physically threatened them, how is it that he can’t criticize people involved in the process? Again, OJ Simpson’s Attorney Johnny Cochran and his stable of lawyers criticized everyone involved at the police department, prosecution, and judge Lance Ito. It was their First Amendment right to do so.
Gag orders are designed to protect the defendants rights, not to shield the authorities from criticism.
