FMCSA says it expects 22 firms to register ELDs

WASHINGTON — The Federal Motor Carrier Safety Administration says it anticipates 20 United States-based and two foreign electronic logging device providers will register ELD devices with the agency.

Those estimates are part of a Federal Register notice to be published Tuesday that the agency is posting in accordance with the Paperwork Reduction Act of 1995.

The FMCSA said it is planning to submit an Information Collection Request (ICR) to the Office of Management and Budget for its review and approval and is inviting comments from the public of the ICR that will be entitled "Electronic Logging Device Registration."

The ICR will be used to enable providers to register their ELS with the FMCSA.

The agency says it anticipates that each ELD provider will register an average of four devices.

"The total of 88 devices exceeds the number of devices that FMCSA is currently aware of, but the agency has opted to use a conservatively high count in order to avoid under-estimating the burden for this ICR," the notice reads.

The agency says it anticipates all ELD providers will submit their registration information electronically.

On March 28, 2014, the FMCSA published a supplemental notice of proposed rulemaking (SNPRM) entitled, "Electronic Logging Devices and Hours of Service Supporting Documents." Specifically, the SNPRM proposed: (1) new technical specifications for ELDs that address statutory requirements; and (2) to require the use of ELDs by those within the motor carrier industry who are currently subject to Records of Duty Status (RODS) preparation requirements. To ensure consistency among manufacturers and devices, functional specifications were published with the SNPRM.

The SNPRM would require providers to certify their compliance with these functional specifications and to register those compliant devices with the FMCSA.

The agency says it expects to publish the final rule by Sept. 30.
