Well if the lead Driver was Drinking he probably was on his break and a few beers to wind down is not a crime as far as the co-driver goes if he felt in danger probably would get out of the truck As I see it your making a big thing out of nothing Does the Lead driver have a record of dui's I think you should maybe get the Facts before you condemn anyone. Was he caught drinking and by who here say is a evil thing be careful. You could get sued

Hey Buddy, don't know where you have been getting your info but, according to FEDERAL DOT rules you are not allowed to drink or posses any form of alcohol in a commercial vehicle. If there is any alcohol you have to be transporting it, have the proper documentation classifying it as hazmat. Furthermore it IS a crime to have a "few beers to wind down" while in service. You must be out of service, not in the commercial vehicle and not return to "on Duty" status for 10 hours. Even if you have drinks outside of the commercial vehicle, then you go in the sleeper, you can be charged with a DUI when the truck keys are on your persons, within your reach or in the ignition.

Think about it this way, you are having a few beers to "wind down" as you say and dispatch calls you for a load. Your co-driver takes the first shift of driving, but he only has lets say 4 hours of available driving time. Now after those 4 hours of him driving you have to take over and those few beers are still in your system. You get pulled over by the states finest for whatever reason, and he makes you blow. Do you just tell him, "Oh I was just having a few beers to wind down" . Do you honestly think he will let you go and say that he understands?

It's good to know that there are Quality folks like you out there drinking then getting behind the wheel of a truck. Makes me feel so much safer while driving.

I have notice that your a moderator and that there was a earlier tread about a owner falsifying A dac report and the tread reference wing nut if your resorting to falsifying a legal doc to get back at your Driver for any reason your not a great owner as you stated you are. And a criminal

Two posts and you're all about giving Wingnut grief...hmm....this thread hit a little too close to home for you? Maybe you "know" the drunken commercial driver about whom this post began.

Either way, the countdown for you has started. Read the rules of the forum and you'll understand why you won't be hanging around here for long.

I WILL go on record to say to everyone that I have NEVER falsified anyone's record ever and don't need to for any reason. I'm one of those people who keep meticulous records and document everything. I find it amusing and sad when people choose to 'hide' behind their true identity and choose to air their dirty laundry & try to ruin others with their lies, half truths, etc on EO instead of being responsible adults and take their grievences either directly to the person they have a problem with or to court/lawyer IF they feel they have sufficient proof of their allegations. I have found in the past that those people who choose to try to slam/ruin someone here on EO are usually the ones themselves who have done something wrong to the very person they are trying to ruin/slam. How ironic is that?
Anyway, we ALL need to get back onto the topic of this thread...which is drivers drinking in a commercial vehicle. The enemy is correct. It IS illegal to drink in a commercial vehicle. Everyone who has a CDL knows this and if you do not, then you had best start reading/studying up on it. I personally feel that anyone who sees their co-driver take a drink inside a commercial vehicle should immediately contact the owner or dispatch. As I've said previously, because of this incident happening with one of my drivers, I have had to put new rules in place with my drivers and add a drinking/texting clause in my contracts. What I had been taking for granted up till now by thinking that everyone knew that drinking in a commercial vehicle was illegal, is now specifically written in my contracts AND told verbally to each of my drivers.

We all know that my sense of humor is a bit warped, so I'm still LMAO after reading Wingnut's statement about the drivers who were arrested for smoking weed when the drug dogs arrived. :eek: Though maybe it's because a long time ago [so long ago that the world was still in black & white], I smoked weed myself. I quit when I realized that it mostly made me feel stoopid, which I could just as well do for free. And probably not get arrested for, either.
Sure am glad I didn't learn that lesson the hard way.

Its OK to start a tread but if you don't include the facts and any evidence to back yourself up your just blowing in the wind....i REALIZE ITS HARD TO BE A LEGEND IN YOUR OWN MINE But lets be realistic and Quit trying to being God

This is from the Drug and Alcohol Testing Rules by the FMCSA..

WHAT ARE THE CONSEQUENCES OF ALCOHOL MISUSE?

Drivers who engage in prohibited alcohol conduct must be immediately removed from safety-sensitive functions. Drivers who have engaged in alcohol misuse cannot return to safety-sensitive duties until they have been evaluated by a substance abuse professional and complied with any treatment recommendations to assist them with an alcohol problem. To further safeguard transportation safety, drivers who have any alcohol concentration (defined as 0.02 or greater) when tested just before, during or just after performing safety-sensitive functions must also be removed from performing such duties for 24 hours. If a driver's behavior or appearance suggests alcohol misuse, a reasonable suspicion alcohol test must be conducted. If a breath test cannot be administered, the driver must be removed from performing safety-sensitive duties for at least 24 hours.

So I would say no, having a few beers to "wind down" while on a break is not ok.

Nope...NOT dougie...he is, in fact, one of my disgruntled ex -drivers who did some things that he shouldn't have done and will be dealt with in a court of law by me......NOT here on EO, which is as it should be. I have found that most of the time people who play the games & try to ruin people by stating their "facts" and "truths" here on EO by claiming they were wronged are usually the very people who wronged the very person they are spouting off about, as in this very case. How very sad! BTW..... Corey1234 is also curtdintc.

The driver that was caught drinking in my truck was caught by 2 of his co-drivers, who did NOT do the right thing and come forward until well after the fact. Eo has strict rules that we all have to obey, and one of them is to NOT name names. BTW corey1234, you are well aware of who's names I will not and can not name on here!
Also, the team that was caught smoking weed in my truck was caught by another truck driver who got my phone # off sign on the sleeper of the truck and called to report what he was seeing. He even stuck around till the police came and gave a statement. Anything else you want to know????
I have no clue as to what you're trying to get at with your ".....hard to be a legend in your own mine......" and your ".....quite trying to be GOD..." statements, nor do I really care. You & I know who you really are and what you did. EO is NOT the place to solve the issues at hand. You have my phone #'s and you know how to dial a phone. Either start being an adult and contact me by phone or in person, instead of trying to hide here on EO, or deal with the consequences. Either way, EO is NOT the place for you or anyone to air their differences, courts of law are and believe me, I WILL be taking you to court.

This thread should have been locked several posts ago and the "accuser" banned...he's broken enough rules to have merited that....
