My guess is Trump's attorney's will get little sleep tonight as they scramble to craft a response and the DOJ attorneys are sleeping soundly in their Florida hotel beds as they wait for tomorrow's hearing.
Are these the same attorneys who were ridiculed and given no chance of success for their filing for a special master in the first place? There's no doubt that they and anyone else with a pulse anticipated this move in addition to the appeal of Judge Cannon's ruling in favor of appointing the special master. It could be that the courts - including the 11th Circuit - will take into consideration this DOJ's strong political bias against Trump and decide there's nothing wrong with an objective third party reviewing paperwork and looking into their activities to make sure there's no skulduggery going on with the documents they may or may not have found in their Mar-a-Lago raid. It's not like this DOJ/FBI cabal has a spotless reputation for honesty and integrity, especially when it comes to Trump or his supporters.

Maybe it's best to sit back and see how this process plays out. Since these decisions could effect past and/or future Presidents, this case will very likely to go all the way to SCOTUS.

Yes, these are the same attorneys who were ridiculed.

No, they were not given no chance of success. The "hand-picked-judge" aspect of this case (believed by many Trump critics) led many to believe the Trump attorney's had a high chance of success. It's kinda hard to not believe that when the judge herself officially announced her "preliminary intent" to rule in Trump's favor before she even saw the DOJ response.

Correct. An appeal was expected by almost everyone regardless of how the judge ruled. What was not anticipated was the astoundingly indefensible ruling the judge made. Her ruling was widely panned by numerous legal experts, including some who once worked for Trump.

Yes, it could be that the courts will take into consideration the factors you cite.

It could also be that the court of appeals will give no concern whatsoever to the reputational damage Judge Cannon talked about, consider the fact that Trump was caught red-handed with property that was not his to have, and caught red-handed with classified documents which presented grave risks to national security by being haphazardly kept at a beach resort, and caught with this evidence via a search legally done under a properly issued warrant. It could be the court of appeals will zero in on the utterly fatal flaws of Cannon's ruling and overturn her.

About that reputational damage, that's a hard case to make since Trump himself has been doing everything he can to tell everyone in the world about the search and its results.

Maybe it's best to sit back and see how this process plays out.
What else can we do at our level? We're ordinary citizens watching this from afar.

The Classification Question in Court Yesterday

As mentioned above, I'm keeping a close eye on what is said about the classified documents in Judge Cannon's court. Having read the joint filing joint filing presented to the Judge today, this comment on Twitter seems to sum things up nicely.

"Trump's team does not suggest the classified documents have been declassified by Trump, but does say that that classification status should not be presume." (Source)

Trump continues to avoid the question in court. The question is plain. Did Trump declassify the documents or not? In public, he frequently claims he did. But in court, he will not say.

For the most part, all we know about the papers, classifications, the sloppy staged photo, etc is what's been released or leaked by the DOJ. The same DOJ that told us for three years that Trump was colluding with Russia. The same FBI that interfered with a presidential election by collaborating with media like Facebook and tamping down the Hunter Biden laptop investigation at a critical time during the campaign. In other words, their credibility leaves something to be desired. There must be a good reason they don't want a special master looking into what they're doing in the Mar-a-Lago process.

Other than the good reasons DOJ has openly cited in its court filings, is there another "good reason." that you know about but the general public does not? What exactly are you getting at when you speculate about a "good reason?"

We also know a court agreed probable cause existed to believe three crimes have been committed that warranted the legal search of Mar-a-Lago and the legal seizure of the materials listed on inventories later released.

It was not illegal for the FBI to seize what the seized. If executive privilege or attorney client privilege is later found to apply to some or all of these materials, they cannot be used for investigation or prosecution purposes. But the FBI was fully authorized by the search warrant to seize the materials they did.

Likely not true and meaningless even if it was. Top secret documents are not kept in people's desk drawers when the desk owner is away months at a time; or, for that matter, even when the desk owner is present.

Just three documents were in his desk drawer where he works. The other documents were all in the storage area. Doesn’t look like there was an attempt to hide documents.
