Implications of new 34 hour restart rule

I wanna know who the rocket scientist was at the FMCSA who decided that this break had to be taken off-duty. IMHO it should be loggable as on-duty-not-driving. I mean, really: Would it be that much more tiring to be on-duty while you're sitting in the truck eating your lunch & playing Angry Birds on your phone, than it would to be off?

Why would you want it to be on duty? I don't see any upside to that. At least it's not going against your 70.

Full disclosure here: I'm a vanner without a CDL, so to me a log is what you use to build a cabin.

That said, I was thinking of the "sensitive cargo" problem Phil alluded to.

Mud dude is correct..I believe. If they log off duty they cannot, technically, be watching the load. If they log on duty-not driving, they don't get the required 30 minute break on their log book. It is a technicality, but is a legitimate concern. It is something that should be addressed by either an exemption or ..... if there is a way to do it legally.... by clarification..... and an explanation of the rules.

When working a guarded load the person on guard is on duty. All time goes against the 70 hour clock. When not guarding one is either in the sleeper or off duty.

So, how ya gonna log it when the new rules require a 30 minute break in 8 hours?

If your co-driver is off duty sleeping and you go off duty to take the dot required break...who is guarding the load?

That's the entire point of this thread.

We are trying not to take anymore of those loads, unless they have a 'safe haven' available. I have not yet received any guidance from FDCC on the subject. I don't know how I am going to log it legally. The reality is that is does not make one bit of difference. After all, when guarding you are just sitting there, being bored, and arguing on EO.

This 'rule', along with many others, point out just how out of touch the 'rulers' are with reality.

I agree, but Phil has a point. You can't be both in service, protecting the load and out of service taking a break. That is the point.

That is correct. As I said, more proof that the "rulers" who control our lives have NO CLUE about reality. It is just another sign of a failing government.

Sounds like a gray area For legal logging you can be in the sleeper and who says sleeper cant be a break. Good question though. HMMMM... I tell ya what Lets NUKE it some more and maybe we can figure it out. HMMM. Ok college Boys ITs a Brain teaser.
