US must stop jailing minors for life, says Amnesty

Amnesty International has called for the US to stop sentencing juveniles to life in prison without parole.

More than 2,500 adults are in US jails for crimes committed as a child - under current rules they will never be freed.

In its new report, Amnesty says the practice is incompatible with the basic principles of juvenile justice.

The US and Somalia are the only two countries not to have ratified a UN convention that bans life in jail without parole for under-18 year olds.

'Potential for rehabilitation'

Amnesty says offenders as young as 11 have faced such sentences in the US.

"In the USA, people under 18 years old cannot vote, buy alcohol, lottery tickets or consent to most forms of medical treatment," said Natacha Mension, of the human rights group.

"But they can be sentenced to die in prison for their actions. This needs to change."

More than half of US states have approved the use of mandatory life sentences without parole for some serious crimes, such as murder.

The US Supreme Court has already acted on some aspects of youth sentencing - and a review is underway.

In May last year it banned sentences of life without parole for minors in non-murder cases.

Earlier this month, it agreed to consider the issue in relation to homicide cases, too; a decision is not expected until next year.

Amnesty's report, This is where I'm going to be when I die, says such sentences are handed down without considering factors such as history of abuse or mental health.

"We are not excusing crimes committed by children or minimizing their consequences, but the simple reality is that these sentences ignore the special potential for rehabilitation and change that young offenders have," said Ms Mension.

Amnesty wants the US to ratify the UN Convention on the Rights of the Child, which has been in force for two decades.

It prohibits the imposition of life imprisonment without the possibility of release for any offence committed by under-18-year-olds.

Fine. Provided Ms. Mension lives outside the U.S. and provided all these rehabilitated criminals are sent to live with her when they are released, never to be allowed in the U.S. to commit crimes again. Otherwise she should shut up and mind her own business.

What is the youngest age a minor could receive a sentence, as described above?? :confused:

It depends on each state. PA is charging a 11 year old, likely to get appealed and 15 year old is the youngest serving in IL. That is just from memory, might find something different.

Thank you - I am just trying to get an idea of what sort of age are they talking about ..... 7yrs, 11yrs, 16yrs?

Kinda funny how many in the world wants the us to stay out of their business yet want to tell us how to run our country.

IMO I think you read that out of context .....

Nope I read the whole thing.Yet for me it goes to the simple action of holding people accountable for thier own actions.Their are some people that now matter what can not be rehabilitated.Anyone committing a sex crime on a child.No one has yet ever been able to say what attracts people to children,yet there are people that belive that people that commit these types of crimes can be rehabilitated.How do you fix something when you dont know what the problem is??Sadly this is a crime that no matter what age you are if you commit you should get at least life with out parole.


A few examples.

The DC sniper.One of the people who carried out ten murders was a minor.They had plans to kidnap children and to use them for ransom and to train them to carry out attacks.This kid got 6 life with out parole sentences.

Back in july of this year there was a teenager who killied both his parents with a HAMMER then hid the bodies and threw a house party for his friends.

Dylan Klebold and Eric Harris were described as teenagers with bright futures, according to reports prepared by the probation officer assigned to work with the youths following their 1998 arrest for breaking into a car. Jefferson County District Court records, prepared when the teenagers completed the program in early-February, a diversion officer (whose name has been redacted by court officials) noted that Harris "excelled in school and never had any problems in this area." Klebold was termed "intelligent enough to make any dream a reality.As far as the law and the experts were concerned these boys were in fact rehabilitated.Tragically they were wrong.

Just a few short months latter they would make two 20 poung propane bombs and try to explode them in their school cafeteria as their opening act of terror on their classmates.When the bombs failedd to go off they started on their shooting spree that killed 12 kids and one teacher,while injuring 21 others.Most know this as the Columbine High School massacre.They went on to turn there guns on themselfs.Had they not life in prison would have been to good for them.

My point is some people can never be rehabilitated.No matter how much people want to belive otherwise.

Seemingly, the premise contained in the above is that if one is not a citizen of a particular state, then the internal affairs of said state are none of that persons business (and therefore, none of the other state's business, which they are citizens of)

If only those who held such views, saw fit to apply the premise not only to others but to themselves, and their own government, as well .... :rolleyes:

Besides, when Amnesty International was queried as to their authority and jurisdiction on this matter their reply was simply:

".... because we said so ....."

So evidently ...... they're golden .... :rolleyes:

I spent about 3 years working at a "youth prison" in PA. It was one of those "outdoor" places. They were given a high school education. They got to travel. Some spent long periods of time on a "wagon train". Other spent months sailing the Carribian on a sailing ship. They received "treatment" while they were there.

The vast majority went right back to their slimy ways as soon as the "graduated" from the program.

Of the 1600 or so I personally dealt with over that time I know of only two that "made it". Both went into the military. One went to OCS. I helped him by writing letters and making phone calls on his behalf. He earned the shot. The rest should have been shot. There was little chance that they would ever reform. It was a real eye opener.

I'll be the first to admit that my tastes border on the somewhat unconventional at times .... but I'm afraid the above combo is just a little too far out there for me .... :rolleyes:

My question is: what kind of juice ..... and we aren't talkin' buttermilk here, are we ? :eek:

Welch's orange pineapple, 1% milk preferably although 2% or 1/2% milk if that's what's available at the store and each unmixed with anything else which went without saying but will be said for the special people.

I think that with the stats, one must actually look at the crimes committed to understand why the sentances are so long. I would agree with AI on the issue but with some of the knee jerk reaction and asinine zero tolerance laws/policies, there is more of a problem with the solutions to some of the issues than the issues themselves. Like bullying laws, which are some of the most stupid thought shaping laws and still they don't do much good unless the schools are more accountable to the parents and the public which they serve. But I was listening to one of the biggest bunch of crap that I ever heard that a state/school district has been doing to discourage kids from learning - taking the to court for things that are minor, like skipping school. I think maybe our society needs to understand the AI's concern and stop screwing around with our kids.

By the way, the younger of the DC shooting team should have been executed.

You do the crime...you do the time. End of story. Violent criminals, and sex offenders whose who are rehabilitated and freed, should be forced to live with their lawyers, or the judges who decreed they were rehabilitated.
