Truck purchase horror story

I'm posting this to warn everyone who's purchasing or lease-purchasing from an owner. What I've gone through could've been alot worse, but losing money is never fun.

Last September I made an agreement to buy my FL-106 from someone who posted an ad on EO. I agreed to pay $1750/month for two years, and get a clear title at the end.

Our contract was flimsy, at best. It didn't state he had to pay all of the $1750 to the finance company. He was financing it for 4 years, and paid around $950/month.

I originally asked if I could send his finance company the whole amount, and he said that's up to him. We went as far as putting both him AND his finance company on the check, but the bank cashed it with just his endorsement.

He had been in and out of work since I bought the truck, so I knew if he wasn't making my full payment he would never catch up at the end. The tip of the iceberg was when he called asking when I'd be making the payment, he needed the money. I started sweating!

Am I going to pay for this truck for two years and have nothing at the end? We decided to send him a letter asking that he get proof from his finance co that everything we paid went on the truck. He ignored it. To make a long story short, I told him his truck was coming back, I'm not paying him a dime more. He revoked his power of attorney at Panther, basically making the truck worthless as a money maker.

I've lost a $6000 down payment, around $7000 in repairs (including a new tranny), and several months of payments. In the end, I'm willing to take the loss because I've learned several things from this ordeal (among those, I'm never touching alumijunk again!) :7

I saw this coming, however, and have been looking for a better situation for a month or so. I've decided to try a different angle at expediting by going on with someone who's respected on this board. I have little doubt that this venture will turn out nearly as bad as my last one.

I would hafta say this whole ordeal also left a sour taste in my mouth about Panther. Overall, they're good... but this situation, I believe, could've been handled a little better... such as telling me the POA had been revoked. But that's for another post.

So, kiddies... what have we learned today??? If you're buying a truck that is being financed, put it in the contract that ALL payments go toward paying off the truck. Don't get into buying someone else's headache if you don't have money to fix it. Have a mechanic check out the truck before you sign anything. And most importantly, have a lawyer look over your contract BEFORE you sign it! It does little good to show him afterwards, and the $200 or so will be money well spent.

Sorry to see that your having so much trouble. I hope that your future is a little brighter. I've heard several horror stories over the past month or so, all related to owners signed on with Panther. I'm really starting to wonder if I should start looking elsewhere for another company to contract with, or maybe even going back to courier work.

Lease purchases more often than not turn ugly.
Cash is King!

Either pay cash for a used vehicle or find a seperate source for financing.
If that is unworkable because of credit or down payment, you are better off driving for someone, or finding something else until the situation is suitable.
Under capitalization is a sure sign of future problems.

THawk, So sorry to hear of all this. Hope things turn around for you. You might try a little smaller company. It has worked out well for me and I think BroomPilot feels the same way. Although I have no idea what went wrong for you. Good Luck

Nothing went wrong for me, other than the owner being less than honest. We believe he planned this from the start. Nothing would've been worse than going the whole two years and finding out the truck is only half paid off.

Panther is a stellar company. Just wish things were different. I had several calls wanting to put my nephew and I in a truck, and we took one. It just happened to be with a smaller company. I'll let you know which one after we run for awhile. Let's just say it's the perfect opportunity in the perfect truck. ;)

Hawk, glad to hear you got something so quickly. Be careful and have fun. Tell me in a private note what the truck looks like so I can keep yelling for you on the CB. I hope it is easier than trying to find the Panther truck you were in. :)

On day to day finances, I think he is right on target.

As far as investing, I lean more towards Clark Howard or Bruce Williams.

At least as far as radio personalities.

Update to the saga:

Dipstick (the owner of the truck) had his lawyer send a letter to Panther telling them not to pay my settlement, or else he'd sue them. After a day, they told us their corporate lawyers advised them to pay us what they owe, and hold the escrow for 45 days before sending that. Their reasoning was to keep Panther out of the court battle that will probably happen between myself and dipstick.

Though I would hafta say I'm disappointed at Panther's lack of communication, both with us and amongst themselves; I'm glad they did the right thing! And for that, they get kudos. Under normal circumstances, I'm sure the headache wouldn't have been this huge.

Thanx, Panther... I'll be happy to do business with you in the future.

It is good to see Panther come to the table with the right outcome. The wheels turn, but sometimes slowly. It probably slowed it down alittle because of the approaching holiday.

I am now driving an argosy with a 30' box, and in a situation I can only tell you is lucrative, to say the least. We'll see as time goes on how I do and how this company and I fit. I'll let you know how it goes. :)

Tell us more about the Argosy. What year? How does it ride? I've thought about that setup a lot as it would sure carry a lot of freight. Who are you running for now? Glad to hear things are working out better. Good luck and take care.

The argosy is the best truck I've ever driven. It has more than adequate space for storage for two drivers. And although the bunk area itself is small, it feels like a studio with it being wide open to the cab.

It's a 2000 with an M-11 370 horse. Gets 10-11 mpg since I've been in the truck. I can haul 20k on it... but feels the same whether you've got 20k or 2k. Smooooooth ride!

I doubt he intentially set out to be a bad guy, he is just a bad guy. Situation arose that he probalby felt flush and could make it back up somehow and knew down deep he could'nt. Sound fimniallar like Social Security.

See how it happens, one wants to be honest but down deep inside is either a Politican, or a crook or the both. Or are they both the same?

If he were honest, I wouldn't think he'd turn down the my offer to pay the lien myself. Or... he would've forwarded my checks that were to be endorsed by him AND his lienholder. The thing that really made it concrete to me what he was doing, was when he called and asked when I was sending payment... cause HE needed the money. I'm not convinced that he didn't have this planned from the start... especially since he was trying to get our money from Panther. He's a crook. No doubt about that.
