WHAT???

Speeding tickets are on of the most fairest tickets there are. You have a choice of getting them or not. I never feel sorry for anyone getting one. It was their choice. You may not agree if you are one that gets them all the time. I can honestly say that I have never had one in my adult life. Am I saying I never have went over the limit. Nope! I just try my best to stay right on the mark as I go down the road. I never go over 65 even when it is 70. And when it is 45, I do 45. Not 47. This has worked for me and saved me money doing it.

Maybe you'll feel differently if you read this. It shows what a racket speeding tickets are and to what lengths those that profit from them will go if the revenue stream is threatened.

Making up the law as they go along

You took that a bit out of context, but thats ok....

the money can be stopped....just don't speed...

Nope. No change. The guy wouldn't be there if he hadn't sped. And the ordeal he went through just trying to make it look like it was the city's fault. He sped, he got caught. Deserves whatever they deem his fine to be. It is just human nature to try and blame somebody or something else for what we willing did.

The law in Nevada was clear: you can't enforce a speed limit without the engineering study. The state did. Who's the law breaker?

I like Ken's solution: Don't speed! Then you won't have to get your knickers all bound up trying to justify the FACT that you were, indeed, going faster than the posted speed limit.

Not just with CSA, but with a CDL in general. Basically, a CDL gets hit with at least 1.5 times the points of a regular driver's license for each infraction, and it doesn't take very many CDL points to suspend the license.

A red light infraction with a regular driver's license is 2 points, with a CDL it's 4 points. Speeding 1-10 MPH over the limit isn't even point-worthy for a regular operator's license, but it's 3 points for a CDL holder.

Each state has their own point system and suspension threshold, but they're all similar with regard to suspending a CDL after a certain number of points within various times frames, like within 1 year, 18 months, 2 years and 3 years.

Correct me if I am wrong but I am pretty sure I heard with csa they count no matter what. Not on your cdl but as far as csa is concerned. Warning tickets count, reduced tickets count as the original speed if reduced after written, tickets you get out of in court count.

so I am thinking a situation here...
we vans are NOT a CMV,
are NOT under FMSCA,
the driver has NO CDL....
driver gets ticket and NO, CSA penalty....
does the carrier get a penalty still??

I'm still hearing YES.

If the driver has to have a DOT medical, then the DRIVER falls under DOT rules, not the van.

But we at E-1 have a DOT because of insurance not the DOT regulations....soooooo

E-1 grants about a 7 day grace period if we get caught away from home to get one done...with the reasoning by law it is not required...they can not do that with the C and D and tractors

FMCSA rules and regulations can't be applied to a non-CMV, but any safety infractions or accidents under the authority of a carrier will count against that authority, same as it always has.

Nope....our compliance Dept....I was in Dallas when my DOT came up....E-1 waits till like 3-2 days before to remind us...MY fault it is my responsibility to know when it is due anyhow...

Safety...aka compliance dept. let me have a week extension, now this is their words...since I am not DOT, FMSCA or HOS complaint...they let it go for a week....

It's funny (sad) how we always look for the Gov. to step in ,take some freedoms away and solve our problems ,all in the name of safety .
but hey ,if it's not going to be apply to us ,so why not ,heck congress not falling under any of the laws they pass as well.

And funny how there seems to be almost a competition among many to show how much they Loooooove to be regulated, almost taking pride in it. "I can give up more of my liberties than you! See what a good citizen I am! Oh, btw, I'm talking about giving up your liberties, too."

I don't doubt you are told right but I keep hearing this The DOT said .. A lot of people seem to forget the FMCSA doesn't actually patrol the roads, the states do. Calling the FMCSA and getting some answers doesn't mean getting the right answers because the states can make some changes to those rules, like require vans to scale or define what is a commercial vehicle on their roads for vehicles registered in their state.
