Not if the documents were connected to business transactions the appeals court determines were legitimate. There were no victims, no one was defrauded, and the appeals court will likely disagree with Engoron's arcane interpretation of NY fraud law just like they did with his obscenely excessive bond amount. They also might not look too favorably on James's campaign for office based on "Get Trump" that foretold her blatant selective prosecution, or the "seize his assets" public jeering that came back to bite her bovine backside Monday morning. "The company that underwrote the bond is Knight Specialty Insurance, which is part of the Knight Insurance Group. The chairman of that company, billionaire Don Hankey, told The Associated Press that both cash and bonds were used as collateral for Trump’s appellate bond.
“'This is what we do at Knight Insurance, and we’re happy to do this for anyone who needs a bond,' said Hankey, who is best known in the business world for making high-risk, high-interest loans to car buyers with flawed credit histories. Hankey told the AP he has never met or spoken with Trump." (Source)
Trump and/or his allies seem to have been mistaken when they previously said no bonding company would underwrite a bond in excess of $100 million. My guess is Hankey extracted a very high price from high-credit-risk Trump for this bond. Hankey is sitting pretty right now, as he extracts a huge fee from Trump and sits on $175 million in Trump's cash and investment-grade securities he put up as collateral.
While this bond forestalls the immediate judgement enforcement actions in Trump's NY civil fraud trial, it is hardly a victory for him. No one would commit $175 million in collateral if not forced to do so. And Trump's doing this makes collection of that amount easy and virtually instantaneous for AG James when Trump loses on appeal (as is widely expected).
The state courts’ Appellate Division has said it would hear arguments in September.
