Depends on who you drive for and whether you are an employee or a contractor. If you drive for a fleet owner like Davekc, who has trucks leased to Panther, you would be contracted (subcontractor) to Dave. Unless Dave was making contributions to your Central States Pension Plan, you are not violating any Teamsters pension agreement. The key words in that 3rd clause are: CONTRIBUTORY CREDIT. If in doubt, spend a $150 and talk to a lawyer.

You can work under a 1099 form as A sub contractor.Or you can start your own such as Flint services LLC This could be your wife's company and you drive a van for her. The benifit in her owning your business is she would get all the write off's.Maintance, fuel, etc. If she did the LLC she should list it as a sole propeiter. She would have to get a fien # .Other than the cost of a van and money to run your business the start up cost for LLC and tax # is under 400.00 dollar's. If you drive for someone else, you can still be an independent contractor, because I am, and so are many others. We are not employees, there are no contributions to any pension/retirement plans, other than what we arrange ourselves.

That is why I say the unions and our nanny government are cut from the same cloth.

Thanks for responding to my situation, everyone, but I would like you all to read something and tell me if you read the same thing I do in this. This is from the Central States Pension Booklet. It says: Prohibited Reemployment after retirement: If you are receiving a pension, you'll be in Prohibited Reemployment IF you perform ANY of the following: (The KEY word here is ANY) 1. Employment in any position, including a managerial or surpervisory position, with any employer that makes contributions to your pension plan. This is the part you are referring to, but read on, please. 2. Employment with ANY employer in any positon covered by a Teamster collective bargaining agreement; OR 3. This is the one that puts me dead in the water...Employment in ANY position IN WHICH YOU EARNED ANY CONTRIBUTORY CREDIT with your pension plan! Now expediting IS trucking and trucking is the industry that I received my pension from, so do you read the same thing I am reading? While it is true it does say employment by any trucking company that is covered with a Teamsters contract, but it goes a little further and to me it says any INDUSTRY and trucking is my industry. Do you agree, I would REALLY appreciate you telling me how YOU do it! Thanks SO much. Jumbuck

what does that mean? It means you will not be allowed to get another teamster job...period.
Please show in your quoted paragraph where it states they will take away your pension payment.
The only penalty they can invoke is prohibiting you from seeking reemployment into a signatory company or from a teamster local hiring hall. Your pension is secure. Every other job, trucking or not, is wide open to you as long as you steer clear of teamster jobs.

Read it carefully word for word and not jump to a conclusion. You received the best advice ever when you were advised to spend $150 and consult with an attorney. Something this important that impacts your future the way this does would certainly justify a small expenditure for peace of mind.

Yeah, what the others said. Normally in expediting, when you drive for a fleet owner (someone else's truck), you are self-employed as an independent contractor. You are essentially renting their truck (or van). The truck is contract-leased to the carrier, and you are contract-leased to the owner of the truck. You are not an employee, but an independent contractor.

Well, thanks again for your replies, but I received it straight from the horse's mouth this morning. I called the Central States Re-employment hot line and they presented it to the "board" and they said driving a van or even a small truck (and beleive me I took a good amount of time explaining to them EXACTLY what I intended to do, and they said driving an expedited van was definatley "prohibited re-employment" and my pension would be suspended if I accepted any job union or not driving anything but a school bus, limo or motor coach. The pension booklet clearly states...If you accept Prohibited Reemployment of ANY kind, your monthly benefits WILL BE SUSPENDED until the first day of the month after you quit working. How will they know? They have THAT covered too. From time to time, we may ask you to give us information reguarding whether you've been working. We also ask that you voluntarily notify us of any job you wish to take. We will check with the Social Security Administration or request income tax documents from you to verify the accuracy of the information you give us. Failure to provide the requested information WILL result in your benefits being suspended. Soooo, I don't know how others do it, but that seems pretty clear to me! As was stated, spend the cash and have a lawyer read it and define it...i trust the Teamsters and the Central States group as much as i trust our government.....

Good advice! Man, you have a good point there!

No, it is excellent advice and he has a great point and so does Xiggi! Spend a few jumbucks and consult with a lawyer to cut through this Teamster b.s. Also apply what is in your sig-line to what the nice person at the Teamster Hotline told you.

My guess is it's been challanged hundreds of times. It's a very old rule. I would research it on the webb or ask other retirees.
If money is short I wouldn't waste it .
If I hit the lotto I'd pursue it as a hobby.
Do you think the op is the first retiree that ever wanted to go back to work.

Sorry Zorry (I've been waiting over a year to use that line) no matter how short the money is, a small fee to a lawyer is an even smaller price to pay to make sure everything is legal. Get legal advice now!

Well Moot, I think yor're barking up the wrong tree !
If Jumbuck found a way around this rule he'd become a hero in the central part of the country.
Thinking of the bus monitor story, if Jumbuck pm's me a mailing address I'll send $20 to the Jumbuck Back To Work Legal Fund.
If all 15,000 readers send him $20 he can send us postcards from the Bahamas .
