Six States Defy Law Requiring ID Cards

WASHINGTON — Six state legislatures are defying a federal law requiring new driver's licenses that aim to prevent identity theft, fraud and terrorism.

The states have passed laws in the past two months, saying the federal law has a steep cost and invades privacy by requiring 240 million Americans to get highly secure licenses by 2013. The 9/11 Commission urged the first standards for licenses to stop fraud and terrorists such as the Sept. 11 hijackers, who lied on residency statements to get licenses and state IDs.

Lawmakers in Maine, Montana, New Hampshire, Oklahoma, South Carolina and Washington say new standards would be expensive to implement and result in a national ID card that compromises privacy. The National Conference of State Legislatures estimates that it will cost states more than $11 billion.

State resistance has drawn criticism from the Homeland Security Department. "I cannot imagine a state official anywhere that would want to have to testify before Congress about … how their non-compliant licenses contributed to a terrorist attack," department spokesman Russ Knocke said.

Knocke said the federal government can't force states to comply. But he said each state's residents are likely to bring pressure on their local governments when they learn they'll be barred from boarding airplanes because their state's licenses don't meet federal standards.

Airline passengers can use other government photo identification, such as passports and military IDs.

Some lawmakers say any inconvenience is outweighed by the cost and potential privacy invasion for each state to create a photo database of license holders.

"The people of New Hampshire are adamantly opposed to any kind of 'papers-please' society reminiscent of Nazi Germany and Stalinist Russia," said Neal Kurk, a Republican state representative from New Hampshire. "This is another effort of the federal government to keep track of all its citizens."

The federal law requires everyone to renew licenses by 2013 with documents showing their Social Security number and home address, and that they are in the USA legally. State Sen. Larry Martin, a Republican from South Carolina, said the law will overwhelm states by requiring agencies to verify documents such as birth certificates.

I think it is really time to tackle a few of the problems with falsified documents and identity theft.

The first thing I am really getting tired of and somewhat offended is the utterly stupid comment “…any kind of 'papers-please' society reminiscent of Nazi Germany and Stalinist Russia†which we already have to be accountable to be a part of the big federal registration system, it is called Social Security and the IRS. Having a single document that indicates who we are is not anywhere near the Germany or Soviet Union but for some reason these idiots don’t have a clue that identity theft is a really important issue for all of us and will continue until we get serious about it.

About identity theft, you know that no matter how hard you try to protect your information, it is all public and you can’t protect it. Your part in protection of your info is simply to eliminate the more common ways of gathering the needed info, your garbage is one way to find all kinds of info on you – shred it if at all possible.

As for what the feds are trying to do, I support because of what I have seen and experienced, but it is a start, not the solution. It starts with getting all the states into the 21st century, not the 19th century. There is no excuse for the states, who receive our tax money to begin with, not to do this, not to harmonize the ID system for the country, but I also feel that we need to have a single driving license system and a federal medical licensing system.

I strongly feel that we need laws that will go after people and put them in jail, like the Mexican who sells false IDs for others to get a job and we are rewarding them by allowing them to stay here and then collect the SS that they stole from our system.

If we are serious about this, it starts with a single step of making sure every ID is the same.

Cost to the states? a staggering $11 billion; cost to each person = $36. I'll pay my share if it will help just a tad.

If Maine, Montana, New Hampshire, Oklahoma, South Carolina and Washington don't want to contribute to the National security for the satisfaction of their respective political agenda, then let the majority rule and opt those States out of the Federal funding they deem necessary for their own pork spending.

Every state had to comply with the .08 for DUI or lose federal highway money. The states sure got in line with that with much griping of course.

The thing is since the shift in how the federal government gather and dispenses our money, they have had a habit of withholding the money from the states unless they comply with the feds mandates, which by the way bypsses a lot of laws about mandates.

Well Terry, at $36 per person is nothing, even the poor can afford that in this country. But again...

Last I checked, drivers liscense is a state thing. If the feds want a federal id, let them issue em. We're forgetting that the reason the 911 hijackers got the liscenses was because the feds (who control renewing visas) dropped the ball. Don't go telling states how to run their business when the feds have a hard time changing their own lightbulbs.

I agree Thawk each state is its own entity.But hey let them go for it now crooks will only have to steal one government laptop in order to steal all our identities.It seems to me that since we already have a Federal ID then we souldn't have to duplicate it.If the government would use the programs they already have instead of trying to waste time and money on new ones or in laymens terms get off their a.. and do their job we would be safe.

I think this is just away to pass blame when the next terrorist attack happens.The 9/11 terrorist gained access to this country legally and then nobody went looking for them when their Visa's expired.How will making people get new drivers licenses help stop that?Why not just improve the Visa program?If they can't find someones who's Visa has expired and they can't stop people from just walking across the border how is a drivers license going to help?

I think that we need to go to a simple rule to identify people who ARE NOT citizens on every peice of government issued IDs.

I don't agree that the states should not harmonize their record systems because they hav eno money, which this is all about. I mean that keeping the information accessable for all states and the feds should be a priority regaurdless if it a states right to issue a drivers license or the fed's right, the states need to do this with all their information.
