Giuliani Sued Second Time by Moss and Freeman

Just days after they received a jury verdict for a $148 million judgement against Giuliani, because he defamed them, they sued him again today. This time they're not seeking money. This time they are asking the court to enjoin Giuliani from telling lies about them, which he continues to tell.

“Defendant Giuliani continues to spread the very same lies for which he has already been held liable,” the new lawsuit said. “Defendant Giuliani’s statements, coupled with his refusal to agree to refrain from continuing to make such statements, make clear that he intends to persist in his campaign of targeted defamation and harassment. It must stop.”

Enforce Now, Plaintiffs ask Judge

There was more to the second lawsuit Freeman and Moss brought against Giuliani than asking the court to order him to stop lying. They are seeking immediate enforcement of the judgement they won last week. More to follow Tuesday.

Judge "Howell gave Giuliani until 2 p.m. Tuesday to respond to the women’s request to speed enforcement of the order." (Source)

Who Owns Who?

Some right-wingers are fond of the phrase "own the libs." In the financial sense, it is literally true that Moss and Freeman own Giuliani. Because Giuliani defamed them, and a court found him liable for that defamation, they now have a stronger legal claim on Giuliani's assets and income than he does.

If Rudy Colludy can't manage to shut his pie hole and stop the defamation ... even with the financial calamity he is facing, then Judge Howell should consider giving him the opportunity of a short stay at the Gray Bar Hotel ... to revisit and reflect his past and current life choices ... and see if that makes any difference in his thinking.

... all while making it very clear that if he continues, the stay can be extended for a much longer period of time in the future.

That seems to becoming an increasingly likely outcome.

Guiliani Files for Bankruptcy

Note that the $146 million judgement against him cannot be discharged through bankruptcy proceedings. In other words, For the purposes of judgement against Guiliani the jury awarded Moss and Freeman, Guiliani's bankruptcy is irrelevant. Whatever assets and income Guiliani may have in the future, Moss and Freeman will still have a legal claim on them and they can still take actions to collect. This will be true to the day Guiliani dies, and beyond.

Also note the bankruptcy court will require Guiliani to provide a full and detailed accounting of his assets and liabilities. That's something he refused to provide in his defamation trial. And that refusal hurt him bad as the jury considered their verdict.

We'll see if Guiliani is equally uncooperative with the bankruptcy court. It is not in his best interests to do so, but that has not stopped him from stupid acts before. If he is not forthcoming in bankruptcy court, he is subject to criminal penalties for bankruptcy fraud.

As despicable as Giuliani's behavior is, and as much as he deserves to be punished as he is, these are civil matters, not criminal. While I'd feel sorry for him behind bars (the tragic story of a once great man who devolved into a pathetic figure), I'll say lock him up if it is proven at criminal trial that he is guilty. And I'll say lock him up the instant he is found in contempt of court for failing to perform as the court requires.

More Trouble for Giuliani

"Either Giuliani directly employs a number of people through this unknown company, and pays them substantial salaries, or the company misrepresented its finances to the government when it applied for the loan — which would likely constitute fraud, a felony."
