Was the space a legal hanicapped spot?
If it had the sign then it is legal if it was just painted on the pavement then it is not.

If it is a legal I wouldn't park there(actually I would, but I have handicapped plates :p)
Maybe the motel saw you an thought you were handicapped and took pity on you:p;)

both a sign which did not have a by law reference like some do.....and painted in spot....

BTW smartbutt....LOL

Why not ask for a different room? I'll ask for a different room if there is anything I don't like about the one they give me. As long as they have other rooms available, I've never had any problems getting one.

Upon checking out...I brought this to the attention of the day manager..same guy who rented it to me....all he could say is the issue never came up but did say it was of interest...

The ADA (Americans with Disabilities Act) rules apply for most locations, and the Manual of Uniform Traffic Control Devices (MUTCD), which incorporates the ADA, generally apply to all publicly accessible roadways and parking lots. Still, parking space markings in largely state statues, with additional or even alternate statues to be found in counties and cities. But it is the state or local law that one must follow.

All states use the MUTCD guidelines and require handicapped parking spaces to be clearly marked on the pavement AND have a sign mounted in such a place so as to be clearly visible from the driver's seat (usually a vertical sign at least 60 inches above the pavement).

Hotels and motels are private property, but just like Kroger, Best Buy and Walmart they fall under the ADA and state and local statues. When I worked for Olan Mills I was in a motel 4-6 nights a week and I saw plenty of people get tickets for illegally parking in a handicapped spot. Some protested because they were assigned a handicapped room. Didn't work. The handicapped parking laws are pretty clear, and I know of none of them who have an "assigned a handicapped room" exception. I was occasionally given a handicapped room, especially when checking in later in the evening after 10 PM or so. Never parked in the handicapped paring space, tho. Not even for loading or unloading my stuff.

Cops don't generally make it a practice to patrol motel parking lots looking for that sort of thing, but there are certain locations in certain cities where they do, mainly due to legitimate (and illegitimate) complaints from either motel clerks or the guests. All it takes is one phone call to the police from some yahoo wanker wanting to get all up in your business to have the police come out and cite you for illegal parking in a handicapped zone.

There are people who get all jacked up if you have a handicapped plate or a temp placard hanging from the mirror and you get out of the car and don't look very handicapped, because you are certainly abusing the placard by using your mother's car or something. These are the same people who will absolutely rat you out if you park in a handicapped zone with no placard at all.

By legal definition....unloading and loading you are only "stopped" keys in ignition, motor running, not parked...

with that said....Next time I'll decline the room....

If it is a legally marked handicap zone, you can't park there.

Next time just park somewhere else - problem solved!

So, IF a motel had handicapped rooms, with a certain parking space assigned to each room, then they would not be able to sell that room to a non-handicapped person unless there were other parking spaces available.

I have seen motels that have assigned spots for each room.

I am just asking questions. A lot of this does not make any sense. Then again, government is involved.

The motel we stay at up north for deer season has one parking spot assigned for each room. None there are handicapped marked. Assuming they were then they could NEVER sell that room to a non-handicapped person IF the space for that room was also marked. A MAJOR reason to NOT provide for handicapped people.

I get a room last night and I get assigned a disabled room...they are drive ups.....I get to my room and they have the markers of disabled...both signed and symbol on the pavement...each room has one....so do I. or don't I? Am I legally entitled? or will Bubba come along and see some quick cash?....Is it fightable?

As OVM stands outside his hotel room, a decision tree runs through his mind . . .

A) Should I go back to the front desk and ask for another room?
B) Should I just take it and sleep with one eye open all night?
C) Should I make this my 16,726th post to the EO forum?

And the decision is: both b and c are correct.:D

Well, I hope your toilet in your room isn't clogged like mine....Hopefully some draino has fixed the problem. Got the E1 16% discount at Red Roof Inn and got to park right in front of my door. (no handicap parking) LOL...got the AC on high and watching the whole 15 channels that I get. 4 ESPNs, 2 CNN's, TNT, USA, DISC, and the locals. Oh, I also get HBO and HBO2 but nothing good on those channels of course. Don't feel like watching "Saving Private Ryan" for the 20th time. Got a crappy KMART next door, and too late for a trip over to Blockbuster video.

speaking of which...someone let their dog poop in front of my room door....IF I were a suspicous person..hmmmm.

When I was a kid, the lady up the street used to let her Scottish terrier poop wherever, including our yard. One day my dad took the poop in a bag to the lady's husband. That dog never messed in our yard ever again.

My room was 59.99 but I talked him down to 47.99....and came with a DVD player and my own specially marked parking spot...:rolleyes:
