With the pending case in front of the Supreme Court with the question whether Texas can execute an Mexixcan national or they have to do what the world court decision, it brings up an interesting issue over the rights of the state vs. the control of the federal government over other issues like interstate commerce and environmental restrictions.
If our court says that the state has no sovereign rights to take care of their own citizens base on external decisions, would this nullify anti-idle laws, stricter emission controls above the EPA's own and set forth that the federal government can set all the rules regardless what they state wants?
