Mileage deduction for fleet owners

Does anyone know who gets the mileage deduction when there is a fleet driver in the van? I pay my driver a percentage and a fuel surcharge and he pays for fuel. How does the mileage deduction work? Do I get to claim the mileage deduction because I am paying for the vehicle maintenance and the insurance or does my driver get to take the mileage deduction because he pays for the fuel? Please share your knowledge with me. Any help will be greatly appreciated.

This is for a cargo van not a straight truck or tractor trailer!

Truck expenses can be deducted in one of two ways.You can deduct all expenses or you can take a standard per mile deduction. In your case neither of you can take the per mile deduction because the expenses were split so you can each deduct only the expenses you paid. Now if you can take some depreciation I'm not sure you have to check the Tax code for that. Hope this helps.
