Allen West is missing the point about Donald Sterling: comments that would have been 'glossed over' years ago are no longer acceptable to most people, and if most people know and/or care] more about sports than politics, whose fault is that?

Yet another point Mr West [and the OP] missed: it's not the US government that wants to "take" Sterling's property, it's the NBA. An Association he voluntarily agreed to become part of, including abiding by their rules & decisions.

That he could be forced to sell is the risk he took when becoming part of the NBA. What doesn't sit well with me is that his extensive history of racist comments and acts [as a slum landlord] were never given the public exposure that would have enabled the public to make their opinions known as well.
If he hadn't become used to being a racist bigoted jerk without any consequences, it wouldn't have gone as far as it did.

I understand all of that I still believe people here have a right to believe what they want. I have no problem fans not coming players not playing people pickiting or anything else. Simply the fact of being forced to sell because you think stupid.

Certainly ... but that doesn't mean that they are also immune or completely legally protected from how others view what they believe, their conduct, etc. ... and whatever actions those others might take as a consequence.

I can see the merits of both sides: the rights of property vs. the obligation someone has when associated with others in a business arrangement.

One thing that might be worth considering is the type of property it is that is in question in this particular case.

It isn't just real property or normal personal property ... it is a type of franchise ...

IOW, some of the value of what is owned is derived from the association with others ...

As part of that arrangement, the others have their own interests ... and rights to act to protect those interests.

In typical business franchises, the rights tend to favor the franchisor as opposed to the franchisee.

No - it can happen where one fails to fulfill contractual legal obligations one might have to others.

Those contractual obligations are the consequence of a (capitalist) market economy, whereby multiple parties enter into a business arrangement ... and they are generally assumed willingly (without duress)

Whether that (being forced to divest one's property) will ultimately be what happens here remains to be seen.

If they said they were no longer going to play against his team that would be one thing. If he is able to sell the team that's one thing. Those talking about confiscation and those approving of it have definite thinking problems as in their thinking is totally defective. Depending on the contract with the NBA they may or may not have any say in things. If they have as much say as to say it's confiscated then he was an idiot to sign that contract.

No that can't confiscate it but they can force him to sell. He says he will take it to the courts but the cancer could get him before that was over.

Funny about the politically correct NBA. This slug SAYS a few words, and the ban him from the game. Not long ago, when Sterling was fined 17.3 MILLION dollars for has ACTIONS as a slum lord, they did nothing. I guess, at least in the NBA actions don't speak louder than words.

Thoughts and words can get you banned, unless you are a player. They can say ANYTHING they want, out loud, during games, nothing is done. Words, and thoughts, that are just as bad, but the name of the game is bouncing balls and owners don't bounce them. ANYONE with money can own, few can bounce, so they are "protected".

I would say that those carelessly raising the possibility of confiscation whether they approve of it or not - when, as far as I know, the NBA has not suggested that - certainly appear to have defective thinking ... this would, of course, include Allen West ...

His defective thinking is not "new news" though ... as he had made a career of sharing of it publicly, on a whole variety of subjects ...

Depending on the contract with the NBA they may or may not have any say in things.
They certainly seem to feel as though they do ...

Since Mr. Silver is himself a lawyer - in addition to undoubtedly being represented and advised by NBA counsel - I would hazard a guess that he may have some basis for how he feels.

If I'm not mistaken, in terms of what you refer to above, Sterling settled that without going to court and being tried, and he did not admit guilt.

So, light of that, is it still your position that the NBA should have done something ?
