hey to everyone im new here. need a little help i own my truck and authority my little brother is buying a truck and wants me to lease him on. can anyone help me with a lease that i can use. i told him that i would cover his plates and permits and ifta and of corse my insurance cargo. he has to cover heavy use tax. we have agreed on a percentage of load + deadhead + fuel surcharge. but im in need of a lease that i can use. i know go to attoney but we are trying to keep it simple and cheap can anyone help. fast3254

Well I would go to a lawyer anyways, not knowing the relationship between you and your brother, but family can be the worse people to deal with if something goes wrong.

If you want it simple write out a contract with exactly the information you just gave us plus cover all the other types of insurance.

thanks for the help he has to bobtail and phys. ill do the rest. we do have a good relationship hell he used to drive for back in 2008-2010 but now he wants his own truck so i told him i would help him.

we are in va there are not any that i can find here do you know a lawyer i can use that wont bust mt balls just really need something simple so he can run and get started dont want to see him let a big company abuse him

OOIDA would probably be your best source of information? Give them a call and ask, they will tell you if they can help or not. If your not a member, the membership is cheap and they will be more than happy to set you up.

I would have to agree with Greg 100% on this one. Still better to put things in writing. Friends and Family will mess you over every time. Been there done that.

Here is some advice as I have learned the hard way trying to hire friends and family members. The two situations you dont take friends or family members into is business or bed. Sure it seems like a good idea but it always turns out bad.:)

Google up the words "Owner operator lease agreement." You will find yourself samples, even some that have been posted on this site. I know that there are sites such as uslegalforms.com that you can go to for a base agreement. Then have a transportation atty look it over and make sure that it meets the requirements of your home state.

Just another option on how to pursue this.

I've been looking high and low for lease agreements to no avail. I called JJ Keller and Associates and they said that they stopped providing master lease agreements six months ago do to problems with them. They suggested that I look for more information on the National Trucking Association's website and I still can't find out much about master lease agreements. I'm gonna call legal zoom today and see what they can do for me. If they can't help them i'm going to have to hustle me up a transportation lawyer!
