In my book, the cow, deer, moose get it EVERY time. You know what kind of critter you are looking at with them. But......if you try to swerve or evade....ya never know what kinda critter is waiting for you in the ditch.

If you try to swerve, it won't matter what kinda critter is waiting in the ditch, cause you'll probably land on top of it, after the truck lays down & slides sideways.
If I can't steer [that's a pun!] around it, it gets hit. If that means I come back as a bug in the next life, well, some days you're the windshield.....

On a side note, Myrian is receiving 3 CSA points. The non-preventable accident is none, but the fact that we had to be towed from an accident scene is one point, and tripled for the recent event..

You should be able to fight this via the Qdata process .
if your safety guy is unwilling to cooperate, go sign for that yourself, and file an appeal.
