Good for Contractors, BAD for FEDX, very BAD for Business.

Now who ya think would win this one? Employee hopefulls or Big Business?

That probably explains why no one has tried to bring a national class-action suit against FedEx Ground on the above-mentioned issues. State laws vary too much for such a one-size-fits-all approach

As it sits currently, it is pending before a Federal judge to determine whether all of the class suits can be combined. Action was brought awhile ago.

Average tenure of eight years? $35,000 to $50,000 annual income AFTER expenses? If things are so terrible at FedEx Ground, why do people stay so long? There are other package delivery companies, are there not?

That may be numbers supplied by Fedex, but is in contridiction to other sources. That may be gross, and not what they actually net. That is confirmed by many of the posts already listed. Average tenure of eight years would be highly questionable as well. I would want to see numbers from someone other than Fedex on that one.

Dave C is exactly right on post #7 they are walking a line ...and remember the whole idea of O/Os is that the company really incurres no real cost of fleet maintenace it on us. But fed ex has no responsibilty other than a true representation of their definition of O/Os and to be up front about it.. if thats the case the ball is in your court to except or decline.. again if the gov can tell the "evil corps" how to run their business they can tell guys like Dave c how to run his... at least with "evil corps " you can walk... with evil stupid gov you are forced with law and guns to comply..

Those numbers did not come from FedEx. They came from the court document. It was a finding of the court that the average tenure is eight years.

If this gose nation wide like OOIDA and many others thin it will.

The costs to Fedex will be overwelming. Some on CNBC are starting to talk soon bangrupcie days? I do nit know.

I do know the entire trucking industry is watching and wishing fed ex good luck.

I know for a fact they do not have a leg to stand on.

Most of us that empoly folks know this as well.
The laws from the IRS are pretty simple regarding an employee or an independant contractor.

What are you?

FedEx Ground is in direct competition with UPS . Even if drivers were classified as employees they would still have the truck expenses . FedEX would have less profit but should still be able to operate at a profit .

The expenses will occur in the Fedex HOME division where Fedex will have to buy back the trucks...and they'll lose any ground made up against UPS in that market.

Canada Post was pulling the same crap when it bought out Purolator Courier. They'd transfer a package from Priority Post to Purolator when the package was going out to the boonies...let a contractor do it for a bucka point!!
Purolator now uses Dynamex to do it's same day deliveries.

Here's an update on the lawsuit involving Independent Contractors and Fedex.

As I understand the article, it indicates increased interest from the government, as they may be missing out on tax dollar revenue they would receive if Independent Contractors were paid employees.

(edited the post to read Independent Contractor rather than owner/operator... although I'm not entirely certain of the difference)

To update this thread and keep the time line complete for readers who may refer to this thread in the future, here is the latest development:

"MEMPHIS, Tenn. – April 21, 2009 – FedEx Ground, a subsidiary of FedEx Corp., (NYSE: FDX), won a United States Court of Appeals for the D.C. Circuit decision today that said FedEx Ground independent contractors are independent business owners – not employees -- and are outside the jurisdiction of the National Labor Relations Board (NLRB). This decision validates the company’s long-standing position that FedEx Ground contractors are small business owners."
