Tell that to FedEx Ground then Greg. I'm sure they would love to have all those cases over turned by the IRS and the courts.
Actually, Bruno, it seems that FedEx Ground is quite pleased with what the D.C. Circuit Court of Appeals has to say about its independent contractor classification.
From the FedEx web site:
"MEMPHIS, Tenn. – April 21, 2009 – FedEx Ground, a subsidiary of FedEx Corp., (NYSE: FDX), won a United States Court of Appeals for the D.C. Circuit decision today that said FedEx Ground independent contractors are independent business owners – not employees -- and are outside the jurisdiction of the National Labor Relations Board (NLRB). This decision validates the company’s long-standing position that FedEx Ground contractors are small business owners."

This 2009 ruling is not the last word on the issue. Anyone discussing this should note that this is a complex issue with numerous jurisdictions involved. It seems that whatever is said about it one way by one authority is said about another way by another authority.
