Drivers Pay

Well we stay out for 2 to 3 months or more and we do the 60% pay scale and our owner is very happy with the money we make him. IT all depends on how well the team runs too. And by law whoever is paying for the fuel is supposed to get 100% of the fuel surcharge. With some owners who pay the 40% and pay the fuel they thereby rule the drivers on where to go and how to run the truck as far as deadhead and such. We have also been out here doind this for 14 yrs so exp. does pay.

Bernie, can you cite the law that specifies who gets the fuel surcharge? Because it's my understanding that there is no such law, though there ought to be - and this is one time I'd sure like to be wrong!

There is no mandatory fuel surcharge law. Many carriers only pay a portion. I do believe they should, but that is another post.

I would have to agree with Cheri, if that was the case why isnt FedEx Custom Critical paying us 100% of the FSC on the runs.

Um, because they don't HAVE to?!
This is one issue that OOIDA has attempted to address legally, without success - possibly because there aren't enough members.
I don't see any justification in not passing along 100% of the FS to whomever pays for the fuel. By whatever name they call it, it's still morally and ethically wrong.
