You can only get a max of 30 points in an inspection so if they do assess the OOS points to you 3 of the points drop off.

I thought the capped it at 30 just trying to wade through the junk can be brain numbing.

Sure can. My company has challenged several violations and had them dismissed. They were grey area violations .

The fact that the inspector in NJ used a mallet to hit my body ubolts and cited me for them being loose sucks, after I had them tightened, which took hrs and a blow torch to heat them up, the shop managed to only move them 1/4" each thereby bending the box rails that the clamps ride on, they still can be moved with a hammer blow! I'd be willing to bet if you go to a new truck dealer and take a hammer to theirs, that they all will move, I cry foul on this test, and when I have the time, I'm going to investigate what it takes to get it removed, although I am just a single truck operator, I can put up a ***** if i need too! Probably my next inspection i'll get sited for bent rails..........

Ok while we're on this topic I have a question. If I look at the FMCSA score of a carrier and I look at a specific violation are the points shown the amount of points both the driver and the carrier got.

For example if the violation was operating a CMV w/o a CDL the points are 10x3=30. So would the driver have 30 pts as well as the carrier?

I know you not supposed to weld nothing to the truck frame, but guess what happens to my U bolts last month. the box may fall off, but the u bolts are not going to fail an inspection. :eek:

Since said driver didn't have a CLD at the time did the points go on after the CDL was obtained?

Yeah when license is obtained/reinstated you already have the points there.

Man, did this take off or what? It would almost be worth having a forum just for DOT questions and issues.
Ive been lucky on some of the bogus violations usualy single pointers but still bogus just the same.
as for the loose spare chain it probably can be considered as loose cargo if it can be moved.
What is the process of disputing violations?

Id fight that spare tire chain.
B.T.W. chains only go on the drives.

It's called the Q-Data appeal process.
it's part of CSA.
it's basically telling the DoT to go back to the officer and ask him if he still think the violation needs to be written . then going to his boss and asking the boss if he will back the driver or back his officer.
Good luck with that.
or you can go to court, only if this is a ticket, if this is a warning, the court will refused to hear the case, yet severity points will still be on the driver & carrier records.
once & If you win a court case, you can then begin the Q data, and have a better case.
but for the time it takes the court to deiced, you already have points on your record.
great system overall.

Ive had nothing but clean inspections since Im in rented NEW trucks but back when I had a Mack 427 Condo and was flatbedding I ran across the DOT who were dead set to find something wrong, problem was Im a crazy man when it comes to maintenance, My truck was shined from top to bottom, what wasnt chrome, was Polished, it was a pretty rig, After crawling all over my rig, fine tooth comb, hes about to say with exasperation in his voice, when he reaches out and grabs my Air and Electric Umbelicals, he says OH MY..THESE ARE SCUFFED BADLY....now they werent in bad shape, yes they had scrub marks but this is nitpicking...he writes the ticket for unsafe air and electric lines, I took of work, took the parts off my truck, along with new ones and another pair of used ones out of our shop, and fought and won the ticket....Common sense, Please,when its revenue generating time theyll find some ridiculous thing like hitting UBolts with a hammer....

Its a way to make money, and get in our pockets, because truth be told, who here is gonna drive with broken springs, bad brakes, a losse box, I mean truly unsafe equipment, Id bet none of you.

Update

Fixed the licence plate light tuesday eve when I got the truck home, and took it to my mechanic yesterday to stamp the dot sheet the spring shop wouldnt sign off untill the light worked.. Fine, I understand his tail in a sling I had no problem with that.
I had untill the end of june on my New York State Heavy Truck Safety Inspection sticker but had him give it an inspection anyway. George looks at the truck the same way a dot is suposed to look at it allong with some common sense. Needless to say it passed I will probly need new rear shoes in a couple months an honest mechanic will tell you that and not sell you a complete axle rebuild.
If I send in a coppy of my mechanics inspection report with my DOT shakedown report I want to show them I run a legit opperation will that be in my favor or will that jost waste paper.

I got pulled over last night in new York on the thruway west of Albany ,reason was he super grouper said ha couldn't read my plate which has 2 super bright led lights on it! Said my liftgate impaired it, he told me to move it to my back door and I told him it wouldn't have a light then he told me nevermind "we have spotlights" I told him dot would ticket me he didn't care.left after 45 min. First time in 7 years on this truck for that one. I'd move it and mount a light on the door pillars but loaders are sure to rip it off

These DOT clowns must really be on steroids and ego boosting pills.. Ugh,,,,tell me why we really need the DOT, I know, it is just another way to generate a source of income from truckers who work for a living so that a lazy government jackxyz can get a pay check, its the same everywhere and again, IMHO>
