I have two small straight trucks on with DeMaris. I'd like to hear for current or former drivers to see if they are having a hard time getting paid for the loads they pulled.

Today I had to hire an attorney to file a lawsuit against DeMaris because they owe me aprox. $9,000.

If anyone else is in behind in payments with DeMaris please PM me.

I went through hell to get $4000 he owed my straight truck. Charles always paid well and around christmas timee he got weird . He avoids calls and slandered me to other companies. All I can say is best of luck getting paid . I will never forget when charles said I cant pay you I have bills to pay.

Btw I can tell you of other companies to avoid via pm only.

It's very sad cuz charles is not a bad person he just has no clue how to maintain a budget.

I have problem with thiefs and cons. I am running under my own authority now and making way better money and less hastles . And I am not only one charles did this to I know of 5 others now .

But I know I am a bad person for doing my job well. God bless you

I'm thinking about just getting my own authority too. How hard was it to get on the all the boards, listed with FedEx and Panther? I've getting my own loads with Charles and he was getting his 18% for me using his board access and factoring and paying me. Unfortunitly he no longer thought paying me was required.

Not hard at all I dont do panther or fedex no problems with them just to busy with the others. I also get lots of ltl freight expediting alone is slow for a solo . So I started ltl plus I am a direct cat vendor so I get freight direct from cat sometimes. point is I am happy running alone.

Now if your truck has irp and ifta its more paperwork but so worthy it.

Btw charles let everyone use his sylectus lol I offered to pay him. When you get mc number your phone and mail will filled with offer

Ooida can help you also they told me whats as nd where to do.

Seems to me, everything except for the original post, which is asking a legitimate question, should be kept to PM's
There is always two sides to every story and it's not up to any of us to judge.
If this is a real problem, then it should be aired in the public forum.
Just my opinion and I'm sticking to it.
I just don't think it's a good idea to slander someone.

I tried to be very carefull in my first post. I will have my day in court, I'm not worried about that. I was just interested to try to find out if this was a new thing with Charles or an on going thing. Also if anyone else is owed money I'd refer them to the lawyer I'm using.

I wiil throw is out for thought, If it is an on going problem, shouldn't there be a way for others to be informed so they don't fall victim too?

If it were an ongoing problem, you would probably have heard about it by now. So how far do these bills date back? $9000 is a lot to suddenly be owed. And if $9000 is owed, then why were you still there after $3000? I had a guy badger me one time about getting paid on jobs, but the problem was, he never turned his bills in on time to get paid on the cycle that he wanted to get paid on.

Charles seems like a very reasonable guy. I'm sure he will weigh in soon enough, and then we will have the WHOLE story.

That amount is owed for loads pulled by two straight trucks. Not sure how you run, but for us amounts to about a two week period involving two trucks. The trucks are now parked because of no pay. I'd be happy to pm you all the dates and amounts if you are interested. As far as paperwork goes, I have rate confirmation sheets, signed bills, and POD's for all the loads in question. All are marked clean and on time and were submitted when delivered.

All of our owner operators or fleet owners sign a contract that states that payment is made within 15 days of receipt of paperwork. Many loads pay quicker than that, but that is what the contract states. Now, there was a problem with a couple ACH payments, a problem at the bank's end which was communicated and we have been working with the bank to resolve. The bank has assured me that the problem has been resolved, the funds were put back in my account, and I ran the ACH deposits through again and the funds for those deposits should be received by Monday.

Now to Mr. Harvey and the rest of the story. Remember that part about 15 days from receipt of paperwork? I received a fax Sunday evening consisting of PODs and BOLs for loads totalling $5694.90 owed to the contractor. That was June 5, but since the fax came at 8:30 pm, we couldn't do anything with that paperwork until Monday morning. This business is a two way street. One of the responsibilities of any contractor is to get the paperwork in to the carrier in a timely manner and the carrier can't get paid without that paperwork. And don't get me started on the amount of money we have outstanding that is owed by brokers we have hauled loads for. Some of those companies advertise on here, but we are dealing with them privately and I'm not going to go starting threads on here telling you how much these companies owe us. What if I waited a couple weeks to bill a broker for a load we hauled and then turned around and told them that they still owed me a check 30 days after the load was completed?

Just a friendly advice, do not go the own authority route undercapitalized .
the # one needs of a small business owners is providing the cash reserve, cash flow and credit line .

Well Charles I can't believe I actually got a response from you. If you answered your phone, called people back, and responed to emails, that might be helpfull in the future.

As far as trying to use the paperwork excuse, good try. My driver has fax receipts for each time he faxed in a copy along with the date and time. Some were faxed in two and three times because you say they never came it or your mom deleted them. To put an end to that excuse I had my drivers fax them directly to me and then I faxed them to your office.

You are correct that I faxed a copy of EVERYTHING, AGAIN, to you on June 5, along with a legal demand of payment letter.

If it will make you feel better I will clearify that only the $5694 is past due the 15 days you reference in the contract. You do have 7 days before you are late on the balance.

You may also want to point out you say paperwork turned in by Tuesday will be paid on Friday, as such I set my drivers pay schedule the same way. Me nor my driver would not have any reason to hold paperwork, our pay depends on it being processed quickly.

I'm glad I got your attention, now maybe this matter can be taken care of. I've been in trucking for over 35 years and have never had this much problems with pay.

Yeppers either the paperwork was faxed in on time and the loads were paid through an ACH which the bank seems to have lost, or the paperwork was late. It's really confusing when you try to use both excuses. If you didn't have paperwork than why would you make a deposit a 10 days ago?
