By his own words, he is an employee.

If he can't turn down loads then it's a slam dunk that he is an employee and shouldn't be paid on a 1099.

True. And fleet owners can easily blur that line by telling them to take everything and not to turn down loads. But of course that never happens in real life

I ignore most of my owners advice. Especially the good stuff.

I would check with tax accountant ,IRS, or go to ask accountant that has a piece on here
and join ooida they will be able to answer any question you may have
check with legal aid, I could never be company driver don't like being told what to do
friends have asked how did you get 5 good conduct rewards in 20 years in navy and you don't being told what to do
have to remember it is all a game , just have know all the rules, and how to bend them
