Co Driver using CLink

We pulled out of the new Pilot in Phoenix this morning. You can only turn right out of the Pilot and I-10 is a left turn. As we made the right turn we saw that the police had set up a rolling scale in the right lane. All trucks were having to go through the scale.

I was sitting in the passenger seat sending my messages on CLink including info on our HazMat reroute. When we came off the scale the officer said, "Are you a co-driver or a passenger? If you are a co-driver your log better say you are on duty not driving or you better get in that sleeper! It is a criminal offense in this state if your log indicates otherwise!"

Now I have the CLink stretched to the maximum amount in order to finish my messages! Wow!

Yepper!! If co-driver is in the jump seat, he/she is legally 'on duty' and must show it on their log..............If the truck is moving, the only time your 'off duty' is when your in the sleeper.

Makes no difference if the truck is moving, parked, or shut off. In the jump seat Equals on duty not driving.

If the truck is parked, shut off, and the keys are out of the ignition, it's a house, and the jump seat is the veranda.

Prolly a good thing I don't drive a truck.

I guess what really shocked me was the officer's statement about it being a "criminal offense in the state of Az." Scary stuff!!

yes but legally you have 15 minutes before you have to change lines. so they catch you they have to prove you wear sitting there over 15 minutes before that

Not to argue, but you are to keep your log book current, which means you have to log it as you do it.

When you pull into a scale and are told to go around back and park you have so much time to update your log book before you go into the scale house. The officer gave India a chance to either update her log book or get back into the sleeper where she should have been going through a scale house.

I believe officers have a nose for this stuff as all of the years I rode with Bob and I went through all of the scale houses in the front seat there was never a question if I was a driver or passenger.

India must have looked pretty professional going through the scales to be called out on it!

You that think you have 15 mins to catch your log up are mistaken,what it says is everytime you change duty status,you must catch it up.The times are rounded off,1st 7 mins equals zero time,after 7 mins equals 15 mins.Now if you were coming into the truck stop an your co-driver just got out the sleeper,being in the front seat would be no problem,same as pulling into the scale,as the scale master doesnt know if your partner was riding or just got up to switch from sleep to drive.Another thing,when your asked if the passenger is a driver or passenger,you better have documents that permit the passenger to be in the truck with you,or they are in for a bus ride.The only reason for an unauthorized passenger,are if you picked someone up and are taking them to the closest garage facilty to get help.

Steve is right a un authorized passenger in the truck is not a good thing. It seems as if every time we pull into a truck stop someone is asking for a ride. If they do not get you in the truck stop they are standing on the ramps with a sign asking for a ride. I know when I rode with Bob we had a form filed with USX and we had a copy in the truck. Since I had a Class A Drivers License we also had to have filed a notarized form saying under no circumstances would I drive that truck.

Moot you hit on one of biggest fears my mother in law had when we broke the news to her we had jumped of the deep end and were going to be come truck drivers! She has since changed her thoughts and Bob's mom and stepdad are our two biggest supporters of what our life style is like.

Safety is who instructed us on the 15 min in the first place and it has gotten me out of having to screw up the run twice when a AZ-dot and a NM-dot officer got after me for pulling into the scale with me in the front seat i said i have 15 min and was looking at logs she agreed but tried to preses it saying she does not know if i was there longer than 15 min and i said for it to be a violation you would have to prove that i was.the other time hey had picture of me with my head sticking threw the curtain to see what was up.after pointing out the 15 min exception plus the fact i was not in the seat they dropped that one as well

now in regards to the ops situation if your filling out load info into the QC your doing truck work and should be on duty

yes the AZ Dot can be a pain in the buzz ,
heck they get all the support they need from the (Mexican) public in the state.

they just overwhelmingly approved a speed and red lights Cameras .

back to the glory story ,
i was once called into a AZ scale house ,to D&H a trailer with a driver that was detained there , he got there with one full hour left on his log , by the time he was done with the inspection he had run out of the 14,
it was 110* out side and the dot officer was inside the AC watching every step we made ,when it was all said and done ,8 log book changes had to be made , and yes he stop me on the way out for a level 3 ...

Question 1: How should a change of duty status for a short period of time be shown on the driver’s record of duty status?
Guidance: Short periods of time (less than 15 minutes) may be identified by drawing a line from the appropriate on-duty (not driving) or driving line to the remarks section and entering the amount of time, such as “6 minutes,” and the geographic location of the duty status change.




Question 13: Are drivers required to draw continuous lines between the off-duty, sleeper berth, driving, and on-duty (not driving) lines on a record of duty status when changing their duty status?
Guidance: No. Under §395.8(h) the FMCSRs require that continuous lines be drawn between the appropriate time markers within each duty status line, but they do not require that continuous lines be drawn between the appropriate duty status lines when drivers change their duty status.


(f) The driver’s activities shall be recorded in accordance with the following provisions:

(f)(1) Entries to be current. Drivers shall keep their record of duty status current to the time shown for the last change of duty status.

(e) Failure to complete the record of duty activities of this section or §395.15, failure to preserve a record of such duty activities, or making of false reports in connection with such duty activities shall make the driver and/or the carrier liable to prosecution.


It would seem that you ran into a DOT person who either cut you a break, or did not know the law.
