CCW and Trucking?

In Michigan if you have a CCW permit, you must present it along with your license and registration when you get pulled over. Even if you are not carrying the weapon at that time. If you don't give it to them, you will be hassled Big time. When they run your plate Number it comes back to them that you have a CCW permit, and possibily be carrying it with you. That is if the truck is registered to you. Look out if he doesn't find out until he goes back to his cruiser, and runs your CDL. How would this affect a CDL Driver? Would other states recognize this permit? Can you carry a weapon in a commercial truck if you have a CCW? Can a you have a CCW and a CDL?
Any driver that has been in this business very long, has been to some very scary locations for pickup or delivery, and it's always in the middle of the night. Detroit/Chicago ECT. Thats the reason for question. I hope I didn't open a can of worms here. I would just like to know. I have started my CCW, and don't know if I should go through with it. A Michigan concealed pistol licensee who wishes to carry a concealed pistol in another state is responsible for complying with the laws of that state

Michigan's concealed pistol law expressly recognizes permits issued by other states to its residents. M.C.L. 28.432a. However, non-residents are subject to the Michigan law while carrying a pistol in Michigan, including those restricting where pistols may be carried, the implied consent provision, disclosure to a peace officer when stopped, and carrying while under the influence. A non-resident should acquaint himself or herself with the Michigan law before carrying a concealed pistol in Michigan.

Similarly, a Michigan concealed pistol licensee who wishes to carry a concealed pistol in another state is responsible for complying with the laws of that state. In an effort to identify which states recognize Michigan issued concealed pistol licenses, each state was contacted by the Attorney General.

Vermont (does not require carry permits by residents or non residents)
Virginia
Washington
Wyoming
Again, anyone traveling in one of these states needs to check their laws, which in many instances are available on that state's website.

Several states have indicated that they will recognize Michigan permit upon entry of a reciprocity agreement. Those are:

South Carolina
Texas
West Virginia
We have advised those states that we wish to enter into such agreements and will sign them as soon as they are received.

Some states allow for the application for a temporary CCW permit issued by that state or local unit of government. Others exempt law enforcement officers.

Federal law expressly provides that persons may carry a firearm in their vehicles while traveling through another state provided that the possession of the weapon is legal in both the states of origin and destination and the weapon is unloaded and carried in the trunk of the vehicle or a locked container other than the glove box. See 18 U.S.C. 926a

Larry: Great response with info about which I've often wondered.. As an expediter not knowing which states we will be going to or passing thru, I would err on the side of caution and leave the weapon at home.

Additionally, a weapon spotted by a customer might cause the loss of that customer, particularly if they are posted. Agreements with carriers might also prohibit the cartage of weapons. You clearly can't go to Canada with a weapon of any sort.

P.S. you don't need a permit to carry wasp and hornet spray in an aerosol can with a forty foot range.

Is wasp and hornet spray what you use for protection? I didn't know they made a spray specifically for White Anglo-Saxon Protestants.:+ :+

Butch - thats a good question. And Larry - thats a good bit of information included in your answer.

I have had my Ohio CCW for a while now, and having an existing CDL was not a problem. In fact, it was never even mentioned.

As I get ready to enter expediting, I too have wondered about the CCW and staying in compliance out on the road. Ohio has a short list of states that recognize our CCW; however, I have heard that PA is willing to issue a CCW to a person who already holds an Ohio CCW, and the PA list of reciprocal states is much more extensive. Don't know for sure if this is true or not. Butch, is MI willing to issue a CCW to Ohio CCW holders based on their Ohio certification?

I know that Canada/US border crossings will immediately cancel all hopes of carrying.

I would feel a lot better keeping my Glock nearby rather than a can of wasp spray - LOL. But I suspose I will take what I can get. I also think common sense and avoiding questionable situations can greatly reduce the need for a handgun.

In addition to Hornet spray which does work I have in the front what appears to be on one end a small flashlight. The other end has a pepper spray that will stop a grizzley bear.I bought it when we made a pickup at a police supply company in Alexandria VA.

Do not bring any weapons across the border.
This includes MACE and pepper spray.
I wouldn't even bring a hunting knife.

Leave 'em all at home folks.
We don't want 'em and you don't need 'em.

Customs is always on the lookout for illegally smuggled weapons and truckers are a prime target.

I will research that for you, as I live in Michigan it should be a quick call or two for me. You, and others interested in reciprocity agreements between the states (hmmm...is that redundant?) can find out much information at www.packing.org.

Rich, while looking up something else I stumbled across this entry at the Michigan State Police web site. I know this only is pertinent to Michigan, but other states may have similar laws regarding pepper (or other self-defense) sprays.

MCL 750.224d Yes, but only if it is either:

Not more than 35 grams of any combination of orthochlorobenzalmalononitrile and inert ingredients (CS gas); or
A solution containing not more than 2% oleoresin capsicum (pepper spray) and is used in the protection of your person or property which would justify the use of physical force. It cannot be sold to a minor.

Followed up on that, state police trooper from my local post informed me that the answer to your question is NO, you must be a resident of the state to qualify for a MI CCW permit.

I knew there was a reason I won't go to Canada. It's a shame too that such a beautiful nation has to be written off because of foolish policies. Unfortunately, the European influence is pervading our great nation as well. I'm beginning to believe I may not live long enough to see the fools win here but I'm still not certain of that.

YUP...you do.

I sent Leo a Private Message to discuss the matter. I don't think the Forum at large wants to repeatly see two completely divergent views on this matter.

OH OH Looks like the worms are starting to wiggle. I didn't mean to start any kind of a Feud here. MY MAIN QUESTION WAS. If you have a CCW, and a CDL and you are NOT carrying any weapons. How will this affect you as a Commercial Driver? Will there be any hassles from police? If your not in Michigan(where I live)would the police have records of Michigan and other states CCWs? Would the CCw show up when your license is run? Just a Concern, about finishing my CCW. I don't want or need any more hassle from them than we already get.

I thought the Fed. Gov. will not allow truck drivers to protect themselves (referenced in the handbook, will try to find it). I for one would like to legally carry something to protect myself.

LDB, so good to hear something so sensible. It just amazes me in this day and age where we have to even worry about such a thing as which states can I legally carry a form of personal protection in without getting in trouble. I read a post by another member stating in a nutshell, to leave the weapons at home because you do not need them. Geez, I wish that guy was with me in October of 03, when I was in downtown Detroit trying to find a pick up at 0600 and had a cute African American female approach my window with what looked like an infant in her arms, and she asked me to roll the window down. I hesitantly cracked it and asked what the problem was......(mind you, this was while I was waiting at a red light) she was crying and telling me her baby stopped moving, and the bus had not come when it was supposed to, blah blah blah. As I was telling her that I would call 911 immediately, I heard a noise on my passenger side, and watched as my side window was smashed in with a tire iron. As I floored the truck, the dude was climbing inside, and blindly swinging his weapon; thank God I had a knit hat on, because my skull took one of those swings. I had enough sense to floor the thing and pull a u turn in the middle of the street, and as I did that, the guy lost his balance and tumbled on to the street, and scrambled back on to the sidewalk. I called 911 and they told me come up to the station and file a report; I had no clue where they were located, and although they said they would send a unit to my location, I politely told them no thanks, and found my pick up with the quickness. In retrospect, I do not believe that guy would have just robbed me and left; I believe my family would be short one male right now, had I not had some serious luck on my side. I can tell you this much: I do not mess with a handgun, but I keep a mailmans mace can in door side pocket, and the day I am told I can not keep such a thing (or at least the day that that rule is enforced) is the day that I stop driving trucks. I guess the other moral of the story is to not let yourself get in a predicament like that either. I CONSTANTLY monitor my side mirrors when I am sitting at an intersection in the dark, and in all honesty, when I am in Detroit during those hours, and making my way to say, how about the good ole Mack Engine Plant, or the Chrysler plant right on Jefferson, if I get caught at an intersection and there are shady looking people nearby, I treat the lights at those intersections as flashing reds. Call me what you want, but you all know the ole saying......"Once bitten, twice shy!"
