Well, it doesn't say "they" have proof, it says this one guy has "irrefutable proof". What it doesn't say, tho, is that his irrefutable proof has already been refuted.
Also, it doesn't say that "criminal charges are filed," it says the same guy in question filed a criminal complaint, which is a very different thing from having charges being filed. Any crackpot can file a criminal complaint, as this story clearly shows.
As for waiting to say or believe anything until it all plays out, sorry, too late. You could make that claim if you had accurately reported what you read, but you failed to do that, indicating that you not only believe your own special version of the story, but that you believe so strongly in your version that you cannot discern actual facts when you read them, and instead change the facts to support your belief. The article was very clear and unambiguous.
