We were at a customer loading Thursday afternoon. In drives a JB Hunt. Out jumps this young driver.The shipper tells him to back into the door next to us ( on our passenger side).Driver has a straight line back,real easy.We're in our box padding and strapping when all the sudden we hear a big crash and the whole buiding shakes.We step into door JB is trying to back into only to find him pulling away from building.He cuts tractor hard right which swings rear of trailer hard left. Also his trailer door on driver's side is swinging freely since there is no door tie.We watch as his door rakes the whole side of our box from back to front.Creases the skin and takes our new three week old paint job down to the bare aluminum.Yelling stop does nothing, by the time he stops damage is already done.

When I ran out to tell him "please don't hit our truck" he replies "I didn't hit your truck and don't accuse me of hitting it".Then he proceeds to hit me with both hands and almost knocks me down. I have customer call the police. I imagine now he wishes I hadn't. Stupidity and a short temper can be costly in many ways!!!

It sounds like you can probably add inexperience & maybe lack of sleep to that driver's list of shortcomings too - but you did the right thing in calling the police. JB Hunt will make your truck good, let's hope they get that guy off the road for good, he needs to train gorillas for a living, or something!

Last time I saw gorillas, they were inside a cage. Sounds like this one belongs there for awhile as well.

Isn't assualt a felony? Let's see - doesn't a felony mean some one can't drive? Correct me if I am wrong.

I would not let it go, I would press charges and really complain to JB hunt.

Streakn1, you handled yourself well in this situation and did right in calling the police and having the other driver charged (I presume). J.B. Hunt will take your claims more seriously now that a police report exists. J.B. owes you not only a paint job but compensation for your down time too. I wouldn't settle for anything less.

Your story reminds me of the value of having a survellaince system on the truck. If that would have happened to us, we would have had the entire episode on tape.

With the prices of digital "point and shoot" cameras starting at less than $100.00, there is no reason NOT to have one in your truck. Photos are a great help when documenting many sorts of incidents.

Freight damage, truck damage, lot lizzards, scenic vistas, or whatever, the man who said " a picture is worth 1000 words" knew what he was talking about! In this incident alone there were numerous PhotoOps. The best would have been the JB "steering wheel holder" having the cuffs put on!

>Congrats, not a fun way to make a buck. Contact a lawyer in that area, and file a suite against the driver and J.B. Hunt. You are entitled to personal damages for him hitting, shuving, you or just plain putting his hands on you.

They will gladly settle out of court. This is also above and beyond the damages done to your truck. I doubt that J.B. is responsible for his actions but they will not want to be named in this suite either. If anyone has ever faced a situation like this please feel to add, I may be wrong but I do not think I am.

I think you definetly have a civil case. Turn on your TV and in 12 seconds there will be a Lawyer advertisng for your business. They salviate over litigation against huge companies.

Before driving I worked as a paralegal and I found that when you hit someoone in there pocket books it hurts worst then jail time.
You need to speak to a civil litagation attorney.
And go for the deep pockets that would be JBHUNT.
And I may be wrong but being a trucker interstate this could go to a federal court, which is better then state court. But the chose where the court would be held would be JBHUNTS.

I have nothing against the big companies but there are that 3-4% out that have no business being on our roads, driver that is. Those that drive and act like they own the highways and drive like the rest of us need to get out of there way, riding our bumpers pulling around us at the docks.

And the shame up it is that most people only see how bad those 3-4% are.

It sounds likeyou did the right thing. You should benefit due to that. I would have blown this deal if it had been me. I would have been mad as hell the the punch would have sent me over the edge. I am puting this is the back of my mind and hopefully I will remember your control. I don;t think I could have. Good job.
