air guns and CMV's

Anyone know of any regulations or information on having an air gun in a commercial motor vehicle? They aren't firearms so they should be ok. They'd be fun for vermin control.

There are no federal laws restricting air guns. Some states and cities have some restrictions, tho. Jersey, Illinois, and Johnson City, TN are the ones I know about for sure who treat air guns the same as a firearm. I think Canada treats it the same way, too, but I'm not positive about that.

a black powder pistol is not considered a firearm under the rules but mass has a firearm law that says anything that fires a projectile you need a lic

Air Guns shouldn't be a problem because "Firearms" are not a problem. If the state you are in allows you to carry a firearm, there is no Federal Rule or law that says you can't have one in a CMV.

Your company might have a rule but it's not in the regs.

Unless otherwise provided in this subchapter, the following explosives shall not be offered for transportation or transported:

(f) A loaded firearm (except as provided in 49 CFR 1544.219).


(the exemption mentioned in 49 CFR 1544.219 above applies only to flying and aircraft)

Whats the slant if it transported unloaded?

Doesn't look like it's covered Federally .... but the ammo is still Class 1 .... although it may be covered by one or more exemptions (including reclassification to ORM-D) ....

Would require a bit of research into the regs as they are fairly involved ..... :D

Firearm –noun
a small arms weapon, as a rifle or pistol, from which a projectile is fired by gunpowder.

So, since no gunpowder is involved in a pellet gun I'd say it's irrelevant.

Why would you want to carry it in the first place?

Vermin control?

Leo, splitting hairs?

Air Guns are as lethal as the firearms, to be exact there are a few high powered air rifles that bring down bear, deer and even larger game.

Vermin control and general plinking fun. Bare hands are just as lethal as well, with the knowledge of how to use them that way.
