Working intrastate

I wish ATCO much success with his new business . Working strictly intrastate exempts you from Federal regulations . I worked for a truck and trail repair company in GA . They worked strictly within the state and logging and drug tests were not required . I could and often did work over 80 hours a week . Problem was they were not required to pay anyone , even shop employees , time and a half for overtime . Make sure you have a good knowledge of the laws of the state you are working in because some states have regulations more stringent than Federal ones .

I don't know who told you that you did not have to log your day, because that is wrong. You still must follow federal regulations regarding inspections, logging and reporting miles for fuel taxes. If you have not done so, hold on to your wallet when you get audited. If you work only in a 50 mile radius, you are then exempt from some logging duties.

I agree with Glen. If you travel more then 100 miles from home you must log.Also the state can look at Joe and say your hours spent on the phone ,doing your billing, lining up loads etc can be counted as on duty time. Best to have a relative do that part of the operation.

You can join a program through OOIDA that will set you up for random drug testing.

In the state of California, the vehicle size decides wether or not Logs are required. I have been told by three defferent commercial enforcment officers that in CA, a Intrastate driver of a vehicle under 26,000 GVW is not required to keep logs - even in commercial, 'for hire' use (In addition, excempt from BIT and CSAT). I believe USDOT rules are defferent in this very regard (isn't the size limit over 10,000 GVW)... There are other variables, such as Hazmat (I will not be doing HM). As I understand it, I am responsible to my states laws in this respect, as an Intrastate operation. Every state is defferent, and just because CA excempts vehicles under 26,000 GVW, doesn't mean others do. Check the state laws first! Like previously mentioned, some states or more stringent than federal.

I worked for a company in GA and things were as mentioned in the original post . I was there for 3 years . Nobody ever took any drug test . The trucks had no DOT numbers , no logs were kept. They operated class 8 tractors .Other employees had filed complaints and were told Federal regs only apply to vehicles that cross state lines . You may be right , they may be wrong but they weren't the only company working that way .

Was the GA operation a timber/logging operation. I belive that is considered agriculture and DOT rules do not apply.

It was a truck and trailer repair company . The biggest customers were intermodal trailer leasing companies - TransAmerica and Xtra.

I will just ad that I did some trucking for a family business many years ago and it was also in Georgia and I did it without a CDL, logs,paperwork,or anything else. There was not a stitch of numbering on those trucks and I can tell you the hours were well outside of any we can currently work. My father and Uncle are passed away so I can not get the exact answer but it was also a long time ago. I think it was as mentioned above though. It was logging and fell outside of any DOT regulations. Not sure of much other than it was in Georgia. Raceman

I know one of the shop workers complained to the Department OF Labor about not getting time and a half for overtime . They worked a 50 hour week . Answer was any business doing all their business within the state is not subject to Federal regulations .
