I recieved a private message in mail box but this is just info that I want to pass on to all Independent Drivers. This info is based on the N.C. laws that I am aware of.
You cannot be a driver and have your Owner Supply you or charge you for Workerscomp. The Policy has got to have you named on it and you should demand a copy for your records if this arrangment is set up weather in N.C. or Tim buc two.
The question was asked he was being charged but was not sure if he was being taken advantage of.
An Idependent Business Person is responsible for his own Workerscomp. An owner of a truck can insist that you carry a Policy but cannot carry a Policy for you without naming you to the Policy. You will probably be further ahead and avoid any fraud if you just get your own.
My last carrier did deduct $ weekly but supplied me with a copy of the policy and #s. That is fair but you need that policy in hand. Do not assume anything with insurance either you have it or you do not and that piece of paper is your future should there be a claim.
N.C. and every state is different a single business operator does not need to carry workerscomp. If you have three or more employees not including yourself than you must carry it. But if your not a corp. than you are personally liable should Johnny get bit by a snake and the bill is $80,000.00. This acutally happened to a friend of mine to one of his employees. (He had W/C) (Rates went sky high afterwards) Even if you have one employee I would get it, if its just you there are chaper alternatives.
But at least he still owns his home, cars, etc...
