What Would You Do?

Ok, Here's what up, company sends out paycheck by mail on Fridays and usually i get it on Monday. Monday comes no check, so i wait, Tuesday mail comes, no check. I send an email to payroll and they say it was sent on Friday. Wednesday mail comes, no check, another email about no check but no reply this time. Thursdays mail comes, no check, send another email, no reply. So my question is.... Just what do i do and or say to get my check, How long should one wait and how long does a company usually wait to issue another check? Thanks, Mike

Mike, you're in a really tough spot. That your second email went unanswered is the clue - they're not sending your check, I bet.
Unless you have an attorney on tap, or can hire one, what you do depends on where you live (contact the state's Labor Dept to file a complaint), and whether you're an OOIDA member (they can sometimes intercede on your behalf).
What I'd do is leave that carrier in the rearview mirror. In a B unit, the pickings may be slim, but really - could it be worse than not getting paid?
PS Do you know whether other drivers are also getting left in the lurch, or is it just you who didn't get paid?

PS If the check really was mailed, I think the policy is to wait 30 days before reissuing it. That they aren't answering your emails is why I think they didn't actually send a check - if they had, they'd want to know what happened to it, doncha think?

Cheri, havent talked to any other drivers yet, When she answered the first email she stated the correct amount they owed, never had problems getting paid or with company before. I figure the check is lost in the mail but i dont know how long someone should wait to just say... send me a new check

Try Hours is the only one who can answer the question, Mike, as they surely have a policy on undelivered checks. [Most want to wait 30 days before reissuing].
If they offer direct deposit, I'd sign up, and if they don't, I'd ask for it - mail is always prone to problems.

30 days? doesnt that suck, seems like the driver always takes the blunt end, lol. If my paperwork gets lost its my fault and i dont get paid, if the check doesnt come, i still dont get paid. lmao. Its like a circus

One of the reasons I prefer direct deposit. A situation of a lost check doesn't exist.

I quess the question becomes, what are they telling you?
To be fair, is it really a lost check, or a company that has ran out of funds?

That company did the Same Thing to me and That's One of the Reasons that I am no Longer with them. Don't even try to Contact the Owner by telephone or in person because He won't get on the Phone and Hides in his Office Till your gone. I Tried to catch him at the Office and even though his Car was in the Parking Lot I was told he wasn't in or he was in a Meeting. I Finally Caught up with him in the garage at the shop cuz I had to go there for supplies and didn't tell anyone I was coming except a Dispatcher Friend who told me that he was there. I had to sneak into the Garage area and Hang out by the Pop Machine till he came out....WE Came to an Understanding and I Started getting my checks regular as Clock Work..You Just Might Have to do the Same Thing I Did..Good Luck!

First question, I'd be asking is "What was the check no. of the check that you issued and sent to me ?"

There should be an answer to that question almost immediately - the only delay involved would be the time for Payroll to look it up. You are best off doing this in person, or at least on the phone (forget email) - so that you can better gauge the reaction of the individual - which might tell you alot.

If you are given a check no. then if/when you receive a check in the mail, you need to verify the check no matches the one given to you, and check the dated cancellation by the post office. Anything doesn't jive .... probably time to walk.

I don't know the situation of that particular company, but recently I have mailed checks to drivers that never did arrive and I know they didn't cash them and claim they didn't get them. We're talking checks to two different drivers that I mailed from the same post office that never arrived. It makes you question the efficiency of our postal system. I would hope that's the case and not the company being in some serious money trouble.

If you go in or phone, (not email), they should be able to call their bank and verify the cheque hasn't been cashed, and you should be able to ask them to immediately put a stop payment on the cheque they issued and re-issue another one and perhaps courier it (maybe they know someone in the area who could use a couple extra bucks? :) ). So they might have to pay a few dollars, it's a cost of doing business (for the carrier).
If you know any others with them that you could call, it would be interesting to see if any have experienced the same thing.
Asking for the cheque number is a good idea too, just to gauge the reaction time.

I try to give the benefit of the doubt untill you screw me, lol. Sometimes it works out , other times not so good. I will call them today to see what the procedure is for reissuing a check is. I like the check number idea. Maybe drivers should get an escrow from the companies to cover not being paid, hahaha

Call them up and tell them that you have called the postal inspectors about the missing mail, tell them that the postal inspector told you to have them put a stop on the check then ask them for the specifics of the check like the check number, speak to yourself as you write it down, repeat the name of the person and and the time it is - see what happens....

I have to agree with you CharlesD. I think it is probably the post office. I use to sell beauty items on Ebay back when I was in the salon. Would send out anywhere from 50 to a couple of hundred packages a week. You would not believe how many packages would 'get lost' or arrive to their recipient emptied of their contents. I always sent priority mail with delivery confirmation so I would know if the package was really delivered or the recipient was trying to pull a fast one.
Because of my experience with the post office I never send money through the mail unless it is a check that can be cancelled or a money order placed in a priority envelope with signature confirmation and insurance.
Matter of fact just sent a money order for 650.00 by priorty mail with signature confirm and ins home to Georgia today, cost $8.50 well spent. (I usually put 50.00 insurance to insure the post office at least try not to lose the envelope, so far it has worked, knock on wood). :D

Well, maybe EO should step in!

Heck, they have ads on here all the time - so do they get their checks on time?

What's their credit like here?

Are they prepaid and if so has a check ever bounced?

Does EO extend credit to them?

You get my drift...........come on EO help this driver out...one of your advertisers may have stiffed a dude.........now what.

Why not just start a union?

Ever hear the notices on the radio or tv: "The views of our advertiser do not necessarily reflect the views of XYZ broadcasting."? I'm guessing EO is the same way.
