truck insurance

got a ? for the drivers that drive for o/o and for owners that have drivers driving there trucks for them.do you as owners make the driver pay for the truck insurance or a part of it out of there percentage? as drivers do you pay a part of the truck insurance out of your percentage? im not talking about the frieght insurance im talking about the damage and liability insurance on the truck its self. thanks in advance for your answers.

I would say no. My personal opinion is who ever holds the truck title pays all insurance related to the truck.
The only exception might be in some type of lease purchase agreement.
In a lease purchase you would have to have very specific language with regards to coverage. I would highly recommend a attorney if you are in this type of situation.
If the truck is involved in a accident, what happens?
Alot of bad things if you don't know your coverage and liabilities.

I don't fit your categories of insureds, but I have a comment anyway.

I have a friend who formerly owned a van leased to a major carrier. He hired a team, that I introduced to him, to drive that van. Both parties were happy and financially rewarded by the relationship, Until the team was involved in an accident that caused considerable damage to the van.

The accident was ruled preventable by the carrier and, admitedly, the drivers were indeed responsible for the cause of the accident. The performance agreement between the van owner and the team did not address the insurance deductable issue. In the end, the team refused to pay the deductable and the owner was stuck with the damage caused by a non-employee party.

I think the owner should cover the deductable for a non-preventable accident and the driver, if not an employee, should cover the deductable for a preventable accident. In either event, the insurance premiums should rest with the owner.

I am not a fleet owner but if I was I would pay the insurance premium. That way you know the premims are paid. Could be a irate driver doesn't pay for some reason,has an accident and you are left with the problems. I also agree with Terry if the driver is RESPONSIBLE for the accident they should pay the deductible but preventable and responsible are 2 different mindsets.Speaking from experience I was charged with a preventable accident that in no way I was responsible for.The police report and various witnesses all exonerated me but my carrier while admitting I was not at fault claimed that I could have prevented my role in the mess.

This incident took place over 3 years ago but still rankles me to this day.

I've heard of percentages being used. Driver A is 75% responsible as he caused the accident, but driver B is 25% responsible because he could have done something to keep it from happening.

I Dispatch for a small co., we have never thought of passing ins. costs on to a driver since it is our truck, but it is a thought maybe some folks would be alot more careful in there drivin habits that is one benefit I can see for the CO. Guess that is why you read that fine print or ask alot of questions.

i wouldn't have a problem paying the deductible if a accident wadeemed driver fault the issue i have is paying the 60% of the mothly prem. on a truck i dont own. thanks for the answers.
