I was pretty much on his side till I got to the part about severe mental pain and anguish. That's the end of any sympathy for the guy.

C'mon, Leo - wouldn't you suffer severe mental pain & anguish, seeing your truck demolished? :p
Seriously, I think the "severe etc" is just boilerplate, thrown in to see what sticks - kind of like when the prosecutors charge someone with 18 different offenses, for the same single thing: if 12 of them get tossed out, there's still 6 left.
While it really doesn't seem to apply in this particular case, severe mental anguish is real enough - I saw quite a bit of it, working on the Trauma Unit, at the county hospital in Cleveland. And it can be every bit as incapacitating as a physical injury, too. One woman, whose husband was killed when she drove in front of a truck (making a left turn), simply refused to live anymore - she refused food, water, medication, everything, and it was quite upsetting for everyone.
Drivers who've been involved in, or even just witnessed, serious fatal crashes can tell you just how bad the mental images can be, if you've never known it firsthand.
Like I said, though, that doesn't apply in this case - it's just thrown in for the heck of it, I guess.

If I had to watch a train run over my daughter I'm not sure what I'd suffer other than severe rage. It certainly wouldn't occur over a broken truck. I'm sure it's in there as a legal ploy because we've become the most litigious society in the history of the universe. That doesn't make it any more reasonable.

The government has "awarded" Stephen Hatfill $5.82 MILLION dollars, for having mistakenly named him as a "person of interest" in the anthrax mailings! That is just total insanity!! They didn't accuse him, even!
I wish they'd consider me a person of interest, too...

Although he was might not have been accused.. he was
assumed guilty by millions of people because of this.
Maybe he did deserve the money.

The Jewell guy in Atlanta that was suspected of the Olympic
bombings finally was cleared and they paid him $1,000,000 I believe. He didn't do either but it ruined his life.
