State officials imposed emergency rules on Monday allowing for the sale of 85-octane fuel in South Dakota for 90 days.
The department implemented the rules at the direction of Gov. Dennis Daugaard, according to a news release. A review of state laws by the department's Office of Weights and Measures in recent months determined that the sale of 85-octane gasoline is illegal in South Dakota, a finding that was confirmed by Attorney General Marty Jackley.
