South Dakota Legislature passes limit on inmate appeals

PIERRE -- The South Dakota Legislature has given final approval to a measure aimed at preventing death-row inmates from filing repeated appeals in an effort to delay their executions.

The House voted 60-5 to approve a bill that has already been passed by the Senate. It will become law if signed by Gov. Dennis Daugaard.

Attorney General Marty Jackley proposed the measure, saying limits are needed in death-penalty cases because some cases are tied up in appeals for two decades.

People convicted of crimes in South Dakota can appeal their convictions and sentences to the South Dakota Supreme Court. The bill says convicts who lose their first direct appeal can only file one additional appeal in most cases.

Not sure that is a good idea because you still have people that have been on death row for years only to be exonerated when DNA tests prove them innocent. Certainly a minority of cases, but I wouldn't want to be the one that finds out and has to says "oops". Might be better to just have a faster appeals process. No good answer on this.

Thats where knee jerk reaction by the courts to order a death penalty....there MUST be NO, none absolutely no doubt whatsoever of guilt....

Hmmm.. found guilty and convicted. Appealed and lost. Now limited to only one more appeal. So, they still have to lose 3 times before they are executed. I'm sure there will be all sorts of hand wringing among the liberals. Good law.
