It would seem to me that when parties enter a lease to purchase agreement that both parties should be equally responsible for any repairs needed to keep the truck on the road earning money.

Assuming who's going to buy the next round off coffee - good. Assuming who is going to make the truck repairs - bad.

Dividing costs on repairs and or maintenance would be complicated.
In a perfect world it is possible. But the normal scenerio will have blame being assigned to both ends.
Driver would think the owner sold him a truck in need of repair, or the owner will think the driver neglected the truck.
Unless the truck is under warranty, this just has the ingredients for a bad business relationship.
One side or the other is going to feel taken.

Well... I agree with everything being spelled out. I was sold a lemon with a bad tranny. Paid $4200 for a new one three months later. But it was in the contract that I was responsible for repairs. So I never went to the owner for money. On the flip side, I was making double payments (to pay it off in two years). The owner made the brilliant observation of making his normal payments and pocketting the other half. With the letter of the contract saying the truck would be paid off in two years, I concluded what he was doing was breaking the contract, as he wouldn't have paid off $20,000 in the end.

In something as complicated as a truck lease/purchase, it's foolish not to have a professional look over the contract. You're talking about a $200 insurance policy for your $25,000+ investment. Get a lawyer. That's what they're there for.
