Another Black man shot and killed in Phoenix, AZ. A struggle occurred during what was reported to be a drug bust, the 34 year old black man was shot after a white officer mistook a pill bottle for a gun. The officer "feared for his life."

"I feared for my life" is the Don't Even Get Charged With Anything and Never Go To Jail Free card. The police aren't stupid, they know what to say. They're professionals at this. They do it for a living.

I don't disagree with you at all Turtle, the police say the guy ran from an SUV, to a nearby apartment. They say there was another young man at the SUV where they found a firearm and weed.

Were the pills percribed or not? They say the man had a conviction (media report) but how many convicted felons do you know own "leagal firearms"? (police report) Someones covering up wrong doing. In the mean time lets keep America divided RACISM ON BOTH SIDES IS HIGHER THEN THE SLAVERY DAYS, AGAIN ON BOTH SIDES.

It's sad because games are being played with lives. You've got cops who may or may not be racist, you've got blacks who may or may not be racist. Some how the hot heads of both groups, keep meeting and It ends bad.

It always race the first thing brought Into the picture. Why? Did the black man run because he had a "legal gun in the car? Probably not, because he had weed in his SUV? Probally not. Well he wasn't alone so if he is a felon he'd be charged for the gun the same as if he had it in his hand even if it wasn't his.

So that leaves us with why did he run? Were the pills percribed to the young man? Police won't confirm if they were or not, because if they were prescribed it looks really bad for the officer. Drugs are found on people of all races, but blacks are the only ones being executed for them. People of all races run from the police, look at Missouri whites are out there rioting also and when the police arrive, the whites run also but blacks are the only ones being executed for running.

Does it really matter? They didn't know about the firearm when they shot him, and he wasn't anywhere near the SUV, he was at his apartment door.

Does it really matter? They certainly didn't look at the bottle close enough to know one way or the other before they shot him. They only looked at it close enough to determine the bottle was a gun.

Or maybe they thought it was a Pop Tart. Same thing.

Regarding the pill bottle, it matters based on what side of the aisle you fall on, the cop was there to investigate a narcotics deal. If the pills were his, and he WASN'T selling them the cop still could have charged him based on a "witness" calling and reporting drug charges. 85 percent of the time if a cop brings a black man into the precinct the cop gets the benefit of the doubt. Oxys are a illegal subtance (dope, unless perscibed) and a firearm was in the car. This might have been the reason he ran.

If he was selling them with the gun in the car this would be another reason he ran because it would bring more charges on him. Who knows?

Riots are happening because blacks are saying they are scared for their lives when confronted by cop, whether they are doing wrong or not. They are afraid police will shoot first ask questions later so they run. The police are doing a good job validating their point.

It doesn't pertain to the shooting turtle. I actually erased that from my post..But my question still stands.. Is it a legal firearm once dope enters the vehicle?

Slo-ride, I know you might not have been asking me, but thats a awsome question. My opinion would be based on if the dope was legal or not. If it was his prescription and he was not a felon, it's perfectly legal. There's conflicting reports on news sites, one says he was a felon, the other said he only had a DUI charge.

A legal firearm is a legal firearm. The presence of an illegal substance, or even committing a crime with the firearm, doesn't instantly render the firearm illegal.

If you rob a bank with a shotgun, you'll be charged with robbing a bank, but you won't be charged with possession of an illegal firearm.

I'm fairly sure having a firearm while in possession of any illegal drug will change the charges. Or in the act of committing a crime. Maybe I should say add charges??

Which illegal drug are you referring too? Police Captain said that he had a medical marijuana card. As for the pill bottle nobody except police know if they were illegal or not. Act of committing a crime? If the pills were his and he was selling them of course thats a crime, if he was selling the weed to someone without a card that's a crime.

Who's to say if he was selling drugs at that moment? The report states he had just arrived at his residence (or his girlfriend's residence) with two bags of fast food, and ran from the police. So the only crime we know of factually is resisting arrest. If we are going to start judging people based on their skin color instead of them being sentenced by a jury, or even worse executing them on sight then that should be written into the law. That's the only logical conclusion I can think of too stop the madness.

I know some might chime in saying or blacks should just stop committing crime, my response to that is all criminals should stop regardless of race.

It'll certainly add to the charges, not unlike the difference between "robbery" and "armed robbery" or simple "assault" versus "assault with a deadly weapon." There may be "illegal possession of a controlled substance while in possession of a firearm," but the firearm itself is either legal or illegal as a separate issue.
