YA'ALL NEED TO KEEP AN EYE OUT FOR USED RENTAL TRUCK ON THE HIGHWAYS. LIKE OLD PENSKI, UHAUL, ETC..BOXVANS. WE HAD ONE LOSE HIS DRIVELINE IN FRONT OF US ON THE FREEWAY AND IT TOOK OUT MY RT FRONT SHOCK, SERVICE AIR TANK, AND IT SCORED MY DRIVELINE SO BAD THAT IT TOO HAD TO BE REPLACED. I PULLED OVER, LIKE I HAD A CHOICE, AND WALKED BACK TO WHERE HE WAS AND FOUND 4 NON-ENGLISH SPEAKING HISPANICS. 1 SPOKE VERY LITTLE ENGLISH AND I GOT HIS INSURANCE CARD AND FOUND THAT HE HAD A DBA, WE CALLED THE TN STATE POLICE AND AND THE DRIVER\OWNER GOT 5 CITATIONS AND HIS TRUCK AND LOAD WAS TAKEN. 1 TICKET FOR NO ANNUAL, NO MED CARD, NO COMMERCIAL PLATE, NO DOT#, NO B.O.L.. HE HAD INSURANCE FOR 4 DAYS PRIOR AND ONLY FOR THE MONTH AND PROGRESSIVE INS DIDNT EVEN DO A BACKGROUND CHECK OR WRITE HIM FOR COMMERCIAL INSURANCE OF $1MIL MIN. AND THIS GUY HAS DISSAPEARED...SO IF YA SEE ANY OF THESE PEOPLE, PLEASE DO US ALL A FAVOR AND TURN THEM IN. IF THEY HAVE NO D.O.T. # ON THE SIDE, TURN THEM IN. YOU KNOW AND I KNOW THAT IF WE DIDNT HAVE OUR PERMITS UP TO PAR AND LOST OUR DRIVELINE'S ON THE ROAD, WE WOULD BE SUED FOR MILLIONS!!!

People this is EXACTLY why I have been BIT&$$#^ about when RE-ENTERING my OWN COUNTRY. (that I seem to get beat up on) Here some FLOPP'N Foreigner can come in here cause damage to one of our vehicles and get completly away with it.

Let me be rude to a Border Patrol Agent GO TO JAIL

Let me not carry Insurance GO TO JAIL

Let me have an accident and the other party finds away to claim that they have a life long dissabilty GO TO JAIL and now my family looses everything. No a S-Corp aint gona protect you when you drive your own truck thinking your protected.. Now if you hire a driver and he has the accident your protected. (feel free to correct me if I am wrong)

Let me not have all of the proper documents in my truck GO TO JAIL or at least pay big penalty even though all fees were paid but document cannot be located.

This is FAIR these people are now Out of a truck until repaired loss of deducatable probably 1K plus all the lost freight. Unbelievable hope yall get back going soon.

EVER SINCE THE FIRST WRECK LAST SEPT 28TH IN GA, (WHICH WASNT OUR FAULT), THE CRAP HAS BEEN FLOWING ON A REGULAR BASIS, AND THEIR ISNT ENOUGH TOLET PAPER TO WIPE IT UP.....LOL I GUESS ITS THE PRICE YA PAY FOR BEING AN OWNER...

The fact that FHWA is now beginning to enforce the regulation requiring DOT numbers and company name on the door will help eliminate illegal operation .

At a shipper in El Paso, a warehouseman punched a hole in the roof of my new morgan 22' box, with his forklift. Pictures were taken, statements were signed. Insurance company was notified, estimate of damage was $1200.00, by Morgan. So all my insurance company had to do was collect from the company at fault. Well guess what..its a Mexican owned company with corporate owned headquarters in Juarez, and every time we tried to collect, they went and hid across the border.

So where does that leave us a year later? Up the river without a paddle. Oh we could spend a thousand getting a judgement, which is not worth the effort. We would still have the same problem trying to collect.

But unfortunately, thats the cost of doing business.

Most states keep an eye on the routes commonly used to avoid scales and nail the trucks that try to avoid the scales .

Broompilot, I think you got it right about Scorp, incorporating, ect. I've talked to guys who really think they're protecting their assets. When you ask them who is responsible for the safe operation of their truck, they will try their best to come up with something other than the obvious answer.

The moral of the story: Don't take legal advice from your accountant. Remember, he benefits from helping you set that stuff up and doing the extra work at tax time.
