[h=1]Pa. kindergartner suspended for bubble gun remark[/h]

MOUNT CARMEL, Pa. (AP) — A 5-year-old Pennsylvania girl who told another girl she was going to shoot her with a pink toy gun that blows soapy bubbles has been suspended from kindergarten.

Her family has hired an attorney to fight the punishment, which initially was 10 days but was reduced to two.

Attorney Robin Ficker says Mount Carmel Area School District officials labeled the girl a "terrorist threat" for the bubble gun remark, made Jan. 10 as both girls waited for a school bus.

Ficker says the girl didn't even have the bubble gun with her and has never fired a real gun. He says she's "the least terroristic person in Pennsylvania."

School district solicitor Edward Greco tells pennlive.com (Attorney: Girl, 5, in trouble for chatting about shooting bubble gun | PennLive.com ) officials are looking into the case. He said Friday school officials aren't at liberty to discuss disciplinary actions.

Two first graders are playing "cops and robbers" at recess in school. One points a finger and says, "Bam!" and the other does the same. Both boy are immediately removed from the playground and are suspended.

Teachers and school administrators are asking, "Is this child's play or a threat of gun violence?"

If you have to ask that question, then you're far too stupid to be in charge of children.

But that's what we have, instead of common sense and intelligence, we get the the typical “zero tolerance” response to so-called violent behavior, which is designed only to protect administrators from having to exercise normal judgment in all possible situations.

Maryland Suspends Three First Graders in a Month for Finger Gun Games
newjerseynewsroom.com

BY BOB HOLT
School suspensions have been increasing in Maryland, and some parents think the punishments have been excessive.

On Thursday, two Maryland first-graders were suspended from their elementary school for using finger gun gestures to play cops and robbers during recess.

Army Sergeant Stephen Grafton, one of the boy’s fathers said, "If anything, this was a teaching point, an opportunity to discuss with the boys and the remainder of the class the importance of not shooting at one another," according to myeasternshoremd.com. White Marsh Elementary School Principal Marcia Sprankle recommended the two boys be suspended.

The Talbot County Board of Education said in a statement, according to New York Daily News, "It is frustrating for school systems, because a complete explanation of events cannot be provided due to confidentiality requirements under the Federal Educational Rights and Privacy Act.”

It could be said that Maryland is a bit jumpy. Earlier this month, 6-year old Rodney Lynch was suspended from school in a different Maryland district for playing finger pistol games.

Cain TV reported that Lynch’s parents appealed, and had the suspension erased from their son’s record. The school has also removed the suspension from Grafton’s son’s record, but there is no report on the other boy.

Child psychologist Dr. Joe Kaine said he didn’t believe any violence was intended. He said most 6-year-olds’ minds aren’t developed enough to understand why such a game might upset parents, according to CBS Baltimore.

The Maryland school board is trying to change its disciplinary policies. The Star Democrat reported that back in April, the board ruled that Talbot school officials did not use proper discretion when they suspended two lacrosse players in 2011 for possessing a penknife and a lighter they used to repair sports equipment.
