Forklift Damage... Anyone?

Would anyone care to share their experience with having forklift damage done to your cargo body at the shipper and what were the results in having them held responsible?

Years ago I had a guy on a fork lift unload a company trailer and not once, not twice, but three times he put the mast through the trailer roof. After the first time I went to find a supervisor to document the damage. By the time we got back there was a second hole in the roof. The supervisor let him continue to unload my trailer while we filled out paper work and I called my company. When he finished unloading the trailer there were three holes in the roof from the mast of the forklift.

When my last D unit was only a month old some guy on the 4-12 ##### whom I believe was drunk slammed into the rear header 3 times trying to get into the box. I finally convinced him with much yelling to stop. He then gave me the name of his supervisor and safety accident person. I rounded up some witneeses,wrote out the situation on paper which they all signed including the f/lift operator took some photos etc. The next day I finished the trip in Charleston WV,reported it too the company,took the truck back to the shipper so they could see the damage while it was still fresh in their minds,got 2 estimates and they paid for the damage plus $300 down time.

looks like the EO sotware can't recognize the difference between shift and #####.

We've all seen people driving cars and doing something stupid because they're talking on a cell phone. How about talking on a cell phone while loading a truck? She was on a stand-up with a tall mast and was on the phone trying to see if there was any more freight to go on my truck. I could see it was going to be a close fit and I told her to stop. She didn't, so I yelled. She looked at me with a "what the hel- do you want" look and hit the header. She made it in and immediately backed out, hitting it again. No visible damage done and the doors are working fine, but I'm keeping my eye on it. Women drivers...

20 foot pipe loaded on just one fork bouncing up and down got it in the truck OK but the unloaded fork, sliced right into the door cutting it like a hot knife thru butter. No lighting on grounds since it was after hours and the light in my box only light up the inside of the box.

The driver was very sorry, I wrote up an accident report. Driver and supervisor both signed it as I did also. They asked me what I though it would be for repair and I was pretty close.

Sent one letter with bill after I paid for repair, no response, than a second letter and fax, still no response, than I followed up with a Certified Registered Receipt Return, with a demanding letter of payment with all of the original copies. Check arrived less than one week later, I than sent a Thank You Note back.

I had a forklift take out the header on my FL and then got all flustered and knocked over some cans of paint that were behind him on the dock. Paint everywhere. The Dock foreman turned some interesting colors as well.

I also had a forklift operator try to make a rack that was too long go in my Sprinter. I yelled but she kept ramming the thing. I guess she thought it was like stomping the trash. Mash it good and you can get more in.

oops left out some details. The damage caused in the first incident was witnessed by several people and I was compensated the full amount for the repair. They also paid for the use of a rental truck while it was being repaired.

On the Sprinter she just re arranged some stuff in my home built sleeper that I was going to change anyway so I just left it at calling her a few names.

First time in 2007 was at the Chrysler plant in Perrysburg. The driver hit the header and pulled it out 10 inches. He did come and get me. We used the hilo to push it in. It looked ok. The next one was at Ford plant in Detroit, Thanksgiving eve. The hilo driver never said a word! I got out to the guard shack and the doors would'nt shut. I looked up at a upper header punched in 2 feet, the roof wriped back 2 feet. $5500.00 of damage and 2 weeks without a truck. They have not replyed to my letters.

I almost forgot the hilo driver works for a company called CEVA. They are a contractor for Ford Motor.
