failed random drug test

I was in expediting for 8.5 years failed a random drug test in 2005 big big mistake how long if ever would a second chance be possible????

Bad news, you cannot legally operate a CMV for upto (most likely) 3 years. If the carrier you drove for at the time of the failed random had a return to work policy, you may have been able to stay with that carrier for the "return to work" and "follow-up" testing period, following the direction of a Substance Abuse Professional (SAP). Sounds like you were terminated at the time of the positive test.

It will be very hard to find a carrier to drive for now that you have that positive test. This will last for a period of three (3) years. I would suggest staying out of trucking for this period - it will save you much frustration. The constant denial of positions would be brutal, and most likely, you will not find a carrier willing to: hire you; assist you with a return to work program; and pay for the return to work program.

The Carrier you were driving for should provide you with information on the consequences of a positive test. You should be referred to a Substance Abuse Professional for additional assistance.

I would suggest you read 49CFR (the green safety regs book) in Part 382.

thank you for your answers to my question I would like to ask another.After three years does this go off my record or will i still have to do the SAP thing? The company did terminate me at the time but they said I could do theSAP and follow up right away. I have read the green book thinking maybe since this happened in 2005 that was enough time. In the book it says the carrier must keep this for two years. One last thing would this be on my DAC report? Thanks again for your help

The regs now stipulate that carriers request controlled substance testing and alcohol records for three years. Carriers you apply to will request such information from your previous employers. The forms sent to the previous employers will ask them to verify your dates of employment, three year accident history, and three year controlled substance/alcohol testing information. These regs were changed on alc/drug testing a few years back from 2 to 3 years.

I do believe the results do show a DAC report, as do your dates of employment, accident history and reason for separation from company. Keep in mind, you have a right to see your DAC report. I suggest you review your DAC report after a three year period to verify that the alc/drug info is removed from your DAC report for the company which you tested positive. At that point you would have a real reason to contest any listing of the violation on a DAC report.

I'm not claiming to be a wizard, but sounds like this--as well as many other things that our fabulous government has instituted--may have a grandfather in it. If it was 2 years when he was on, it maybe 2 years for him. I don't see why they would have a problem, provided there aren't anymore positives in between and none while continuing to drive. But that's just my take on it.
