The FMCSA places great emphasis on carriers to ensure that owners operating under their authority and all their drivers’ qualifications are valid and current. It is not just enough to verify and record a driver’s CDL and endorsements, medical certificate, and/or medical waiver document, drivers must have these documents in their possession at all times while operating a commercial motor vehicle. Failure to produce a required document could subject the driver to one severity weight point. If a medical certificate or waiver is expired, one point could be awarded (§ 391.49). No CDL or an expired CDL could subject a driver to 8 severity weight points. (§ 383.23)
A driver who fails to comply with an operation out of service order will be subjected to 10 severity weight points. A driver who does not speak or comprehend the English language will receive 4 severity weight points.
