dot and the blue tooth headset............

I got a level ll inspection today in my straight truck in New Jersey, one of the first questions the inspector asked me was where my headset was for my phone, he didn't see it on my head when I scaled, so I pointed it out hanging on my cb mic cable. He apparently was satisfied, however I did get written up for not having my spare tire locked in the slanted holder on the side of my truck, , when I had some tire work done, the tire tech didn't lock down the chain clasp, boy talk about nit picking..........Be careful boys and girls, they're out to get ya
At least i didn't get a ticket. And because of that I didn't get a sticker for my window either. The other write up was for a loose box to frame u clamp, that moved after he struck it 2 times with his rubber mallet, sheeeeeeeeeeeeeeeeeeeeeeeeeesh what next, old stale air in the tires?

TK, thanks for posting this.
yes according to the FMCSA, the new role apply to the phone itself, but we can still reach and grab just about anything else within reach. like blue nail or something.
FMCSA did not address yet the question regarding drivers use of cell phone as a GPS.

sorry about your bad luck, but if it was me i would rather get the ticket then the warning. as roadside warnings impact the SMS score the same as ticket, but we cannot fight it via the Q data process .
i was reading over the weekend about a loophole in the Qdata process that will probably allow a well informed layer to dismiss most 'visual' tickets. it is probably cost effective in the long run to pay a layer.

the loose Ubolts are a known problem with St. trucks, and we needs to be aware of that, your not the only one.

So what would of happened if you told him you didn't have a blue tooth headset? Would he take your phone to see if you had any texts or calls while driving? Can you refuse any such requests?

I thought the cell phone law didn't go into effect until after the first of the year.....somebody straighten me out if I'm wrong, please.

On the national level. States may have their own already. OR, they are already mining for revenue. They figure that can get away with it.

Inspectors are NOT ALLOWED to use tools during an inspection other than measuring devices. Hammers, pry bars ect. Can't be used. I could move the whole truck with the right pry bar and hammer. Could I then tell you your tires were bad?

Don't argue with an idiot, they will drag you down to their level and beat you with experience.

Tomorrow is just your future yesterday.....

True that, guess I wasn't thinking about individual states seeing how so many 4 wheelers in these states seem to be ignoring any hand held law the state may have in place.

Communities can have handsfree laws too: there are currently 2 near Cleveland, Oh. North Olmsted and Brooklyn will cite anyone holding a cell to their ear.

NJ is a hands free state. But like other states they cannot look at you phone just because they want to see if you made calls.

If you don't have a headset, throw the phone on the bed in the sleeper if you get pulled over for an inspection.

Yeah, now this one I do believe! I can't understand how these DOT officers get away with the crap they do! Even my husband says he hopes he never sees a driver giving a DOT officer the old slug-a-feist because he doesn't know if he would stop and help the officer or wave when he went past with a good job to the driver. That is sad! Some of these DOT officers are out of control.

Just curious can some one show me in writing the rule that says DOT officers are not allowed to use hammers, rubber mallets, or maybe a tire thumper?

I have the same question. It is a popular claim among drivers that DOT inspectors are not allowed to use tools during an inspection but I have never been able to find anything official to support it.

I ask those who say the claim is true, how do you know?

Georgia uses ball peen hammers but mainly on dump trucks, they check the dump body and leaf springs for cracks but they do like to bounce it down a frame too.
