[FONT=&quot]Included in FMCSA regulation § 392.4, is the requirement that no driver shall be on duty and possess, be under the influence of, or use, any of the following drugs or other substances: (1) Any 21 CFR 1308.11 schedule I [controlled] substance, (2) Any amphetamine or formulation thereof, (such as “pep pills’ or “bennies”), (3) A narcotic drug or any derivative thereof, or (4) Any other substance, to a degree which renders the driver incapable of safely operating a motor vehicle. (In this section, possession does not include manifested material being transported as part of a shipment. Violation of this regulation will subject a driver to 10 severity weight points.[/FONT]

[FONT=&quot]The FMCSA regulation § 392.5 states, in part: A driver may not be on duty or operate a commercial motor vehicle while the driver possesses wine, beer or distilled spirits. FedEx Custom Critical does not transport alcoholic beverages; therefore, possession applies to any location in any vehicle leased or owned by FedEx Custom Critical. Such possession will subject a driver to 5 severity weight points.[/FONT]

[FONT=&quot]Additionally, a driver may not use or be under the influence of alcohol within 4 hours before going on duty, or operating, or having physical control of a commercial motor vehicle. To do so, a driver is subject to 5 severity weight points. (note: a FedEx Custom Critical driver who intends to consume any amount of alcohol, must call dispatch and take himself or herself out of service. If no drivers will be available, the truck must also be taken out of service.)[/FONT]
